MAY 28, 2001

Minutes of a Regular Meeting of Council held on Monday, May 28, 2001 at 7:00 p.m. in Council Chambers City Hall.

Present: Mayor Phil De Vos, Councillors Arnelien, DeRyk, Fromm, Goulden, Wegner and Wyatt.

Staff Members Present: Wayne Jensen, Laurie-Anne Rusnak, Lonnie Kaal, Terri Eger, Scott Mack, Gord Bulmer, and Jody Hauta. Recording: Gloria Signarowski.

A quorum being present Mayor Phil De Vos in the Chair called the meeting to order at 7:00 p.m.

HEARING OF PETITIONS

Ben Weber – Yellowhead Highway Conference Report. Ben Weber, the City’s representative on the Yellowhead Highway Association was present in Council Chambers. He gave a report from the Yellowhead Highway Conference which he attended on April 26 to 28, 2001 in Edmonton, Alberta.

Tourism Yorkton – Proclamation of Tourism Week

A letter dated May 24, 2001 along with pertinent background information from Tourism Yorkton was circulated for the consideration of Council.

Mr. Terry Wright, President of Tourism Yorkton was present in Council Chambers and spoke to their request.

That the Council of the City of Yorkton authorize Mayor De Vos to proclaim the week of June 3rd to 9th, 2001 as "Tourism Awareness Week" in the City of Yorkton.

Mr. Terry Wright presented Mayor Phil De Vos with a cheque, which represented the money, that Yorkton benefits from Tourism, being $12.5 million.

George Skutar – Untidy and Unsightly Premises – Junked Vehicles

Two Orders dated May 7th, 2001 to Mr. George Skutar along with pertinent background information regarding untidy and unsightly premises and junked vehicles at 67 Lawrence Avenue were circulated for the consideration of Council.

Mr. George Skutar, owner of the property was present in Council Chambers to speak to these orders and advised that he needed more time to clean up the property.

That the Council of the City of Yorkton enforce the Orders to clean up the property at 67 Lawrence Avenue, effective ten (10) days from May 29, 2001 with the exception of removal of any vehicles that are not Mr. Skutar’s personal property, that they be removed no later than July 31st, 2001, and that all costs associated with the clean up orders be applied to and form part of the tax roll.

Bylaw 14/2001 – Amend Zoning Bylaw 9/96 – Commercial Permitted Uses

Councillor DeRyk – Change of Council Meeting Times

A memorandum dated May 23, 2001 from Councillor Dick DeRyk was circulated for the consideration of Council.

Councillor DeRyk advised that some Members of Council had a discussion after the last Special Council Meeting regarding the change in Council Meeting Times. He has been advised that not all Members of Council are able to meet earlier than 7:00 p.m. and based on this information, he withdrew this item from the Agenda with the approval of Council.

That Mill Rate Bylaw 15/2001 be amended to accommodate a Commercial tax phase-in with the addition of Number 3(i), (ii) as follows:

  1. that a Commercial tax phase-in of 50% for 2001 and 100% for 2002, excluding new improvements, be implemented for the 2001 taxation year. The Commercial tax phase-in to be calculated based on the dollar difference between the total tax levy from all taxing authorities (school, library and city) for the year 2000 and the year 2001 tax levy (calculated on the public school mill rate together with the municipal mill rate).
  2. To finance the 2001 tax phase-in, a 1.5 mill levy shall be applied on all commercial properties with the balance of the commercial tax shortfall to be allocated from the City’s accumulated surplus.

That the Council of the City of Yorkton approve the discretionary use application under the City of Yorkton Zoning Bylaw No. 9/96, Section 7.3 R2A – Transitional Residential, Part C – Discretionary Uses: Day Care Centres, for 82 Fifth Avenue North and approve the Discretionary Use Application under the City of Yorkton Zoning Bylaw No. 9/96, Section 7.1 R1 – Single Detached Dwellings, Part C – Discretionary Uses: Day Care Centres, for 59 Bull Crescent provided that all regulations and licensing requirements are approved by the Province and subject to obtaining a City of Yorkton Business License.

That the Council of the City of Yorkton authorize the Mayor and City Clerk to issue a Certificate of Approval to the applicant to subdivide Lot 5, Block 83, Plan No. 82Y00321 as the proposed subdivision meets all of the requirements of the City of Yorkton Zoning Bylaw No. 9/96, Section 7.4 R3 – Multiple Unit Dwellings, 7.7 General Provisions.
