JULY 22, 2002

 

Minutes of a Regular Meeting of Council held on Monday, July 22, 2002 at 7:00 p.m. in Council Chambers City Hall.

Present: Mayor De Vos, Councillors Arnelien, DeRyk, Fromm, Goulden, Wegner and Wyatt.

Staff Members Present: Laurie-Anne Rusnak, Matt Bernat, Lonnie Kaal, Stu McFadyen, Jeff Humble, and Fran Brimacombe. Recording: Gloria Signarowski.

A quorum being present Mayor De Vos in the Chair called the meeting to order at 7:00 p.m.

APPROVAL OF MINUTES

Regular Council Meeting Minutes - June 24, 2002

Discretionary Use Application - 125 Elizabeth Avenue

No one was present in Council Chambers to speak for or against the Discretionary Use Application at 125 Elizabeth Avenue.

Untidy & Unsightly Premises - 90 Bailey Drive

There was no one present in Council Chambers to speak for or against the untidy and unsightly premises, order issued for 90 Bailey Drive.

That the Council of the City of Yorkton authorize Administration to proceed with the clean up of the untidy and unsightly property at 90 Bailey Drive (Lot 2, Block 11, Plan 59Y05945), with the cost of the clean up to be added to and form part of the tax roll.

54 Tupper Avenue

There was no one present in Council Chambers to speak for or against the untidy and unsightly premises order issued for 54 Tupper Avenue.

That the Council of the City of Yorkton authorize Administration to proceed with the clean up of the untidy and unsightly premises at 54 Tupper Avenue (Lot PD, Block B, Plan 42488) with the cost of the clean up to be added to and form part of the tax roll.

8 South Front Street

Mr. Gino Astolphi owner of the property was present in Council Chambers to speak to the order.

That the Council of the City of Yorkton postpone the untidy and unsightly order for 8 South Front Street for seven (7) days and that the appropriate City staff meet with Mr. Astolphi and explain to him what the requirements are for the clean up and following that meeting if the property is not satisfactorily cleaned up, then the City shall proceed with the order with the clean up costs to be added to and form part of the tax roll.

Bylaw No. 19/2002 - Appoint a Deputy Mayor

Bylaw No. 20/2002 - Landscaping Bylaw

A memorandum dated July 19, 2002 from the Urban Planner along with a proposed Landscaping Bylaw were circulated for the consideration of Council.

That Bylaw No. 20/2002, a Bylaw of the City of Yorkton to provide for the requirement of landscaping in all future commercial and major residential subdivisions be introduced and read a first time this 22nd day of July A.D. 2002 and referred to the Municipal Planning Commission for formal review.

ADMINISTRATIVE REPORTS

City Manager - Contaminated Sites

A memorandum dated July 9, 2002 from the City Manager regarding contaminated sites was presented for the consideration of Council.

That the Council of the City of Yorkton authorize the proper signing officers to execute the Contribution Agreements for the contaminated sites located at 32 Seventh Avenue South, 42 Betts Avenue and 80 Seventh Avenue South, that any costs that exceed $30,000 per site be taken from the Accumulated City of Yorkton Surplus and that Administration be authorized to carry out the work as contemplated by the agreement.

Kahkewistahaw First Nation #72

Municipal Servicing Agreement

A memorandum from the City Manager dated July 18, 2002 along with a Supplemental Agreement to the Municipal Services Agreement between the City of Yorkton and Kahkewistahaw First Nation #72 were circulated for the consideration of Council.

That the Council of the City of Yorkton authorize the Mayor and City Clerk to execute the Supplemental Agreement to the Municipal Services Agreement entered into on January 5, 2001 between the Kahkewistahaw First Nation #72 and the City of Yorkton to include Block 63 and all of Parcel “Z”, Yorkton, Saskatchewan, Plan 68Y04659, Except all those portions on Plans 72Y07045 and 88Y11708.

Property Manager - Application for Cash Back

A memorandum from the Property Manager along with a copy of the Cash Back Policy No. 10.40 of the City of Yorkton were circulated for the consideration of Council.

That the Council of the City of Yorkton approve the application of Ferrcon Homes Ltd. for cash back, in the amount of $3,984.75 on property purchased at 190 Seventh Avenue North (Lot 17, Block 18, Plan 87Y07168) in accordance with the City of Yorkton’s Cash Back Policy.

That the Council of the City of Yorkton request Administration to prepare an amendment to the City of Yorkton Infill Housing Policy for cash back, to be brought back to Council, delegating authority for approval to the City Manager.

Discretionary Use Application - Day Care Centre - 125 Elizabeth Avenue

A memorandum dated July 16, 2002 from the Principal Urban Planner along with a letter dated May 19, 2002 from Ms. Naomi Walkington were circulated for the consideration of Council.

That the Council of the City of Yorkton approve the Discretionary Use Application for Naomi Walkington under the City of Yorkton Zoning Bylaw 9/96, Section 7.5 R1- Single Detached Dwellings, Part C-Discretionary Uses: Day Care Centres, for 125 Elizabeth Avenue.

Proposed Subdivision for Yard Site

A memorandum dated July 15, 2002 from the Principal Urban Planner regarding a proposed subdivision for yard site was circulated for the consideration of Council.

That the Council of the City of Yorkton reply to Saskatchewan Municipal Affairs and Housing indicating that the City has no objections to the approval of the proposed subdivision application for the SE ¼ Section 32-25-3-W2nd as presented in the Saskatchewan Municipal Affairs and Housing letter of July 8, 2002, as it complies with the Yorkton Planning District Development Plan Bylaw No. 13/94 and the Yorkton Planning District Zoning Bylaw No. Z2-94.

Proposed Subdivision SW ¼ - 1-26-4-W2nd Plan No. 82Y00321 (Russell Drive)

A memorandum dated July 10, 2002 from the Principal Urban Planner regarding a proposed subdivision along with pertinent background information were circulated for the consideration of Council.

That the Council of the City of Yorkton authorize the Mayor and City Clerk to issue a Certificate of Approval to the City of Yorkton to subdivide proposed Parcels 14A and 14B, Block 80 in SW ¼ 1-26-4-West of the Second as the proposed subdivision meets all of the requirements of the City of Yorkton Zoning Bylaw 9/96, Section 7.4 Multiple Unit Dwelling District (R3) and 7.7 General Provisions.

That we accept Recommendation No. C00057-2002 as contained in the Committee of the Whole Council Meeting Minutes of July 22, 2002 that the Council of the City of Yorkton authorize Administration to close City Hall for business on December 27, 2002 with the condition that the staff take the day as a vacation day or a lieu day.

City Manager - City Transit

That we accept Recommendation No. C00058-2002 as contained in the Committee of the Whole Council Meeting Minutes of July 22, 2002 that the City proceed with Option 4 in principal as outlined in the Transit Report from the City Manager dated July 5, 2002, with Administration to review the hours of service and the rates, and provide a formal report containing recommendations for Council’s further consideration.
