REGULAR COUNCIL MEETING MINUTES

NOVEMBER 4, 2002

 

Minutes of a Regular Council Meeting held on Monday, November 4, 2002 in Council Chambers City Hall, commencing at 7:00 p.m.

Present: Mayor De Vos, Councillors Arnelien, DeRyk, Goulden, Wegner and Wyatt.

Staff Members Present: Wayne Jensen, Matt Bernat, Bill Hawkins, Lonnie Kaal, Jeff Humble, Stu McFadyen and Bonnie Schenher.

Recording: Gloria Signarowski.

A quorum being present Mayor De Vos in the Chair called the meeting to order at 7:00 p.m.

APPROVAL OF AGENDA

That the Regular Council Agenda be approved for this Meeting of Council.

BY-ELECTION RESULTS/INAUGURATION

A memorandum dated October 29, 2002 from the Associate Returning Officer regarding the Statement of Results from the By-election held on October 23, 2002 was circulated for the information of Council.

Mrs. Bonnie Schenher, Associate Returning Officer read the Statement of Results of the By-election held on Wednesday, October 23, 2002 and declared Janet Hill elected as Councillor for the City of Yorkton until the next general election to be held in October of 2003.

Mr. Wayne Rusnak, City Solicitor then officially gave the declaration to Councillor Janet Hill and Councillor Hill took her seat.

HEARING OF PETITIONS

Royal Canadian Legion – Proclamation – Veterans Week

A letter dated October 23rd, 2002 from the Secretary/Manager of the Royal Canadian Legion was circulated for the consideration of Council.

Mr. Ross Gilbert and Mr. John Zaretski were present in Council Chamber to speak to their request.

That the Council of the City of Yorkton authorize Mayor De Vos to proclaim the week of November 5th to 11th, 2002 as "Veterans Week" in the City of Yorkton and that their flag be raised on Tuesday, November 5th, 2002 at 10:00 a.m. at City Hall Park.

Association of Professional Community Planners of Saskatchewan

Proclamation – World Town Planning Day

A memorandum dated October 28, 2002 from the Urban Planner regarding World Town Planning Day was circulated for the consideration of Council.

That the Council of the City of Yorkton authorize Mayor De Vos to proclaim November 8th, 2002 as "World Town Planning Day" in the City of Yorkton.

City Clerk – Health Levy Petition Amendments

A memorandum dated October 31, 2002 from the City Clerk/Director of Human Resources regarding the Health Levy Petition was circulated for the consideration of Council.

That the Council of the City of Yorkton authorize the City Clerk to remove the names as outlined in the report of October 31, 2002 from the Health Levy Petition, which will be received and filed by Council on November 4, 2002.

Lorna Kristjanson, Chairperson – Presentation – Health Levy Petition

A letter received on October 31, 2002 from Lorna Kristjanson, Chairperson of the Committee concerning the health levy petition was circulated for the consideration of Council. A blank copy of the petition was also attached. Ms. Kristjanson was present in Council Chambers and spoke on behalf of the committee and presented the formal petition to Council.

That the Health Levy Petition be received and filed as presented. Carried.***

Mayor De Vos advised that a report verifying the petition by the City Clerk would be brought back in due course.

ADMINISTRATIVE REPORTS

Urban Planner – Proposed Subdivision – Heritage Site

A memorandum dated October 21, 2002 from the Urban Planner regarding a Proposed Subdivision Heritage Site along with a copy of the application were circulated for the consideration of Council.

The Urban Planner along with a Member of the Municipal Heritage Advisory Commission, Mr. Gene Deneschuk were present to give further background information on this subdivision.

Goulden – Wyatt

That the Council of the City of Yorkton authorize the Mayor and City Clerk to issue a Certificate of Approval to the applicant to subdivision proposed Parcel B on SW Ό Section 3-26-4-2, as the proposed subdivision meets all of the requirements of the City of Yorkton Bylaw 9/96, Section 11: Parks and Recreation.

Development Plan and Zoning Bylaw Review

A copy of the proposed Development Plan and Zoning Bylaw were circulated for the consideration of Council.

The Urban Planner gave a brief presentation on this and asked that Council review the document and then they could set up a meeting to discuss the issues of concern.

That the Council of the City of Yorkton receive and file the draft copy of the Development Plan and Zoning Bylaw as presented by the Urban Planner.

Director of Finance – Tax Enforcement

A memorandum dated October 31, 2002 from the Director of Finance regarding tax enforcement proceedings was circulated for the consideration of Council.

That the Council of the City of Yorkton accept the attached property list under Section 3 of The Tax Enforcement Act, after which the Treasurer will proceed with enforcement as outlined in the legislation.

City Clerk – Appointment to Personnel Committee

A memorandum dated October 31, 2002 from the City Clerk/Director of Human Resources requesting an appointment to the Personnel Committee was circulated for the consideration of Council.

That Councillor Wyatt be appointed to the Personnel Committee.

UNFINISHED BUSINESS

Councillor DeRyk – Payment of 2002 Health Levy (verbal)

Councillor DeRyk gave a verbal presentation on what will be done with the 2002 Health Levy that has already been collected.

Discussion was held on this matter.

That on November 30th, 2002 the City of Yorkton remit that portion of the levy that has been collected at that date and remit on a monthly basis those portions, which have been collected in subsequent months.

With the consent of the seconder, the mover withdrew the motion.

That one-fifth (1/5) of the City of Yorkton’s commitment be remitted on December 31st, 2002 to recognize our first year commitment to the health levy.

That this Regular Council Meeting move into a Committee of the Whole Council Meeting at 7:45 p.m.
