NOVEMBER 17, 2003

Minutes of a Regular Meeting of Council held on Monday, November 17, 2003 in Council Chambers City Hall commencing at 7:00 p.m.

Present: Mayor Phil De Vos, Councillors Arnelien, Goulden, Hill, Maloney, Schmidt and Wyatt.

Staff Members Present: Wayne Jensen, Laurie-Anne Rusnak, Lonnie Kaal, Jeff Humble, Bill Hawkins, Troy LaFreniere, Kelly Kaban, S/Sgt. Gourlay and Bonnie Schenher. Recording: Gloria Signarowski.

A quorum being present Mayor Phil De Vos in the Chair, called the meeting to order at 7:00 p.m.

Public Notice – Bylaw No. 39/2003

- Amends Yorkton Zoning Bylaw No. 14/2003

There were no petitioners present in Council Chambers to speak for or against Bylaw No. 39/2003 which amends Zoning Bylaw No. 14/2003.

Protective Services Commission- Smoke-Free Public Places

A memorandum dated November 13, 2003 from the Chairman of the Protective Services Commission was circulated for the consideration of Council.

Mr. Michael Redenbach was present in Council Chambers along with Dr. Sahib Shahab to make a presentation regarding smoke free public places.

Mayor Phil De Vos thanked them for their presentation.

Recommendation No. 03-37

That the Council of the City of Yorkton accept Recommendation No. 03-37 as contained in the Municipal Planning Commission Meeting Minutes of November 5, 2003 to accept changes to Policy #10.180 as follows:

  1. That all buyers be treated equally regardless of status as a builder or individual and be given a tax free holiday on the land and the dwelling constructed until 90 days after the insulation and vapour barrier inspection.
  2. That all taxes start 90 days after vapour barrier inspection regardless of status as builder or individual.
  3. That bon-a-fide builders constructing bon-a-fide spec homes be allowed to apply for an exemption of taxes until the home is sold or occupied.
  4. That municipal utilities be paid by all purchasers from the date of hook up without holiday.
  5. That the City of Yorkton, undertake at cost, the registration of all titles as instructed by the purchaser.
That sentence 12.1 be changed from "Building & Development Officer" to "Manager of Building Inspections and Property."

That the Council of the City of Yorkton accept Recommendation No. 03-38 as contained in the Municipal Planning Commission Meeting Minutes of November 5, 2003 to accept changes to Policy #10.40 as follows:

  1. That the Municipal Planning Commission recommend to Council that this policy be extended for an additional three years.
  2. That it be amended to reflect recent changes in inventory and administration.

Recommendation No. 03-39

That the Council of the City of Yorkton accept Recommendation No. 03-39 as contained in the Municipal Planning Commission Meeting Minutes of November 19, 2003 to accept the changes to Policy #10.50 as follows:

  1. That no taxes be applied in the building permit year and that the first full year after the year in which the building permit is issued to be abated at 100% and then the second, third and fourth years be abated at 75%, 50% and 25% with full taxation taking place in the fifth year.
  2. That all zoning references be changed to reflect adoption of City of Yorkton Zoning Bylaw 15/2003.

A memorandum dated November 13, 2003 from the City Clerk/Director of Human Resources regarding the 2004 Council Meeting Schedule was circulated for the consideration of Council.
