REGULAR COUNCIL MEETING MINUTES

AUGUST 9, 2004

 

Minutes of a Regular Council Meeting held on Monday, August 9, 2004 in Council Chambers City Hall commencing at 5:00 p.m.

Present: Mayor Phil De Vos, Councillors Arnelien, Goulden, Hill, Maloney, Schmidt and Wyatt.

Staff Members Present: Jeff Humble, Laurie-Anne Rusnak, Lonnie Kaal, Bill Hawkins, Michael Buchholzer, Bonnie Schenher, Cindy Alcorn, Kelly Kaban, and Jillian Savage. Recording: Gloria Signarowski.

A quorum being present Mayor Phil De Vos in the Chair called the meeting to order at 5:00 p.m.

APPROVAL OF AGENDA

PUBLIC ACKNOWLEDGEMENTS

Mayor De Vos advised that the City had some vandalism at the Cemetery and the Funeral Homes, businesses, and volunteers of the community came forward to assist with the repairs of the 10 grave markers that were broken and 48 which had been toppled over. Council Members provided certificates of appreciation to the following for their efforts: Kopan’s Funeral Service, Christie-Hill Funeral Chapel & Crematorium, Yorkton Memorial Gardens Crematorium & Family Center, Bailey’s Funeral Home & Cremation Services, Good Hall Memorials Ltd., Remco Memorials Ltd., Logan Stevens Equipment, Carla Skikewich, Brianne Fullawka, Kris Trotz, Kevin Borden, Tim Boulton, Freddy Senchuk, Bill Yaremko and Ken Washek.

Councillor Schmidt offered congratulations to the organizers of the Annual RCMP Golf Tournament held at Deer Park Municipal Golf Course recently.

HEARING OF PETITIONS, PUBLIC NOTICES AND PRESENTATIONS

Associated Engineering Ltd. – Water System Expansion Project

A memorandum dated August 4, 2004 from Michael Buchholzer, A. Sc.T., Waterworks Manager regarding a report by Associated Engineering on the status of work completed on the Water System Expansion was circulated for the information of Council.

Mr. Darren Anholdt, P. Eng, Project Manager of Associated Engineering was present in Council Chambers to make a presentation and update City Council on the status of the Water System Expansion Project.

City Limits Inn/Bar and Lounge Owners/Employees

- Smoking Bylaw No. 38/2003

A letter dated July 13, 2004 from Mr. Marty Derbowka, a letter dated July 22, 2004 from Victor and Marie Derbowka, and a list of names on a petition regarding the deleterious effect that the Smoking Bylaw No. 38/2003 has had on many businesses in the City of Yorkton were circulated for the consideration of Council.

Mr. Terry Wright, Manager of the Travelodge Hotel was present in Council Chambers to speak on behalf of the businesses in the City of Yorkton.

That the Council of the City of Yorkton amend Bylaw No. 38/2003, (Smoking Bylaw) to exclude lounges, bars and private clubs until January 1, 2005 as long as underage children are not allowed in/on the premises.

SIGN – Proclamation – Fetal Alcohol Spectrum Disorder Day

September 9th, 2004.

Letters dated July 12th and August 4th, 2004 from SIGN regarding a proclamation were circulated for the consideration of Council.

Ms. Terry McGillivary along with Ms. Tamara Dobmeier were present in Council Chambers and spoke to their request.

De Vos to proclaim September 9th, 2004 as "Fetal Alcohol Spectrum Disorder Day" in the City of Yorkton.

SIGN – Grant Application – Families and Schools Together Program

A letter dated July 15, 2004 from the Executive Director of SIGN regarding a grant application was circulated for the consideration of Council.

Mr. Tom Seeley, Executive Director was present in Council Chambers to speak to their request.

Mr. Seeley was encouraged to have SIGN apply for a grant through the Community Grants Program with the Leisure Services Department, and to engage the services of the Community Grant Writer which would be hired shortly.

Public Notice – Discretionary Use Application

-Residential Care Home – 328 Second Avenue North

There was no one present in Council Chambers to speak for or against the Discretionary Use Application of Virginia Kulaway for a Residential Care Home located at 328 Second Avenue North.

A Memorandum dated August 4, 2004 from the Personnel Committee regarding the SUMA Meritorious Service Awards was circulated for the consideration of Council.

Bylaw No. 19/2004 – Amend Zoning Bylaw No. 14/2003 (1st reading)

That Bylaw No. 19/2004, a Bylaw of the City of Yorkton to allow for Contract Zoning for Chris Stoubis, Iris Stoubis and Theodoros Karachalios at 516 Broadway Street West (Lot C, Block 63, Plan No. 72Y07045) and to amend the Zoning Map attached to Bylaw No. 114/2003 be introduced and read a first time this 9th day of August A.D. 2004.

A memorandum dated July 22, 2004 from the Junior Planner regarding SaskEnergy Regulation Station Subdivision, a letter dated July 6, 2004 from the Community Planning Branch of Government Relations and Aboriginal Affairs and an application to subdivide the station were circulated for the consideration of Council.

Downtown Streetscape Design

A memorandum dated July 28, 2004 along with a letter dated June 23, 2004 from the Chair of the Downtown and West Broadway Corridor Steering Group, a letter dated July 21, 2004 from the Downtown Business Association and a letter dated July 20, 2004 from the President of the Yorkton Chamber of Commerce along with Recommendation No. 04-33 as contained in the Municipal Planning Commission Meeting Minutes of June 30, 2004 and Recommendation No. 04-29 as contained in the Protective Services Commission Meeting Minutes of June 29, 2004 regarding the downtown streetscape design were circulated for the consideration of Council.

That the Council of the City of Yorkton approves a combination of both Option "A" (full bulb-out design) and Option "B" (half bulb-out design) as the most practical design, and that they direct the Downtown/West Broadway Steering Group to have the Consultant prepare a flexible plan that can accommodate both designs, but that a minimum of two intersections (2nd and 3rd Avenue) be designed for construction of full bulb-outs to test the impact and the public reaction.

Crosswalk at Broadway Street and Maple Avenue

A memorandum dated July 28, 2004 from the Director of Planning and Engineering along with a map and a letter from Mr. Bill Oliver, owner of McDonald’s Restaurant dated July 27, 2004 along with Recommendation No. 04-27 as contained in the Protective Services Commission Meeting Minutes of June 29, 2004 and Recommendation No. 04-32 as contained in the Municipal Planning Commission Meeting Minutes of June 30, 2004 were circulated for the consideration of Council.

That the Council of the City of Yorkton approve the design and construction of the "refuge island" for the Broadway Street and Maple Avenue crosswalk (City Library and McDonald’s), which includes curb work, bollards, and low-lying plant material, and that monies for this capital improvement come out of the 2004 Engineering Budget.

CMHC Design Charrette

A memorandum dated August 4,2004 from the Director of Planning and Engineering regarding CMHC Design Charrette and pertinent background information regarding the process, were circulated for the consideration of Council.

That the Council of the City of Yorkton authorize Administration to proceed with finalizing and executing a contract agreement with CMHC which will outline the Terms of Reference for the facilitation of a Planning Design Charrette as a component of the Downtown and West Broadway Redevelopment Plan.

GIVING NOTICE OF MOTION

Mayor De Vos – Curfew Bylaw

A memorandum dated August 4, 2004 from Mayor Phil De Vos regarding curfews in the City of Yorkton was circulated for the consideration of Council.

Mayor Phil De Vos passed the Chair to Deputy Mayor Schmidt at 6:53 p.m.

Mayor De Vos gave a brief presentation regarding his concerns for the possible implementation of a Curfew Bylaw and each Councillor provided their views on the issue.

That we accept Recommendation No. C00052-2004 as contained in the Committee of the Whole Council Meeting Minutes of August 9, 2004 that City Council direct City Administration to continue negotiating with the tenant and the owner of Lots 24-27, Block 7, Plan 7023 and Lot A, Block 7, Plan AH2756 to achieve the best price possible, and that the City proceed to purchase the property as long as the purchase price does not exceed $117,000.00.

That we accept Recommendation No. C00055-2004 as contained the Committee of the Whole Council Meeting Minutes of August 9, 2004 that the proper signing officers execute the agreement with Human Resources Services Ltd., as amended, (Section 3(a) being amended to reduce the number of assessment and counseling sessions; to correctly number the agreement; and to amend Section 19(b) to provide for either party to terminate the agreement upon ninety (90) days notice and to remove reference with respect to failure by the City to enter into negotiations) for the provision of an Employee and Family Assistance Program.
