REGULAR COUNCIL MEETING MINUTES

DECEMBER 13, 2004

Minutes of a Regular Council Meeting held on Monday, December 13, 2004 in Council Chambers City Hall commencing at 5:00 p.m.

Present: Mayor Phil De Vos, Councillors Arnelien, Goulden, Hill, Maloney, Schmidt and Wyatt.

Staff Members Present: Wayne Jensen, Laurie-Anne Rusnak, Lonnie Kaal, Jeff Humble, Don Kunkel, Bill Hawkins, Gord Bulmer, Cindy Alcorn and Sean Alcorn. Recording: Gloria Signarowski.

A quorum being present Mayor Phil De Vos in the chair called the meeting to order at 5:00 p.m.

APPROVAL OF AGENDA

That the Regular Council Agenda be approved for this Meeting of Council.

PUBLIC ACKNOWLEDGEMENTS

Councillor Maloney acknowledged the organizers and talent in "A Christmas Carol" presentation with proceeds to Salvation Army and the Soup Haven.

Councillor Schmidt acknowledged homes and businesses in the community for their festive displays.

Councillor Goulden introduced the new Maintenance Manager at the Agriplex, Sean Alcorn, who is a journeyman electrician.

Mayor Phil extended an invitation to the community to join the Battery Commander, Battery Sergeant-Major and all ranks of the 64 Battery 10th Field Regiment R.C.A. at a New Year’s Day Levee on January 1, 2005 at 11:00 a.m. at the Armoury.

HEARING OF PETITIONS, PUBLIC NOTICES AND PRESENTATIONS

Public Notice – Bylaw No. 27/2004

– Business Improvement District (BID) Bylaw

Downtown Business Association representatives, Terry Pollock, Lorne Brown, Bill Oliver and Gerry Smysnuik as part of the Committee, were present in Council Chambers to speak for the Business Improvement District Bylaw.

Mr. Terry Pollock and Mr. Lorne Brown gave brief presentations in favour of this project to Council. They summarized the results of the community survey and advised that 98% are in favour. An Open Meeting was held on December 6, 2004 and 50 to 60 people were in attendance. There are 269 businesses involved and there will be an 11 person Board to administer the BID.

CUPE Collective Agreement – 2005 to 2008

A memorandum dated December 8, 2004 from the City Clerk/Director of Human Resources along with pertinent background information were circulated for the consideration of Council.

That the Council of the City of Yorkton authorize the Mayor and City Clerk to execute the proposed Collective Agreement with CUPE Local 342 as presented, for the 4 year term beginning January 1, 2005 and expiring December 31st, 2008 providing for wage increases of 2.25% for 2005, 2.25% for 2006, 2.50% for 2007 and 3% for 2008 and to provide for a one-time signing bonus of $200.00 per full-time employee and $100.00 per seasonal employees who had completed 480 hours of service in 2004.

Out-of-Scope Staff Increases – 2005 to 2008

A memorandum dated December 10, 2004 from the City Clerk/Director of Human Resources regarding out-of-scope staff increases was circulated for the consideration of Council.

That the Council of the City of Yorkton authorize the City to provide for out-of-scope wage increases of 2.25% for 2005, 2.25% for 2006, 2.50% for 2007 and 3% for 2008, an increase of $5.00 per month to the City benefit allocation March 1st, for each of 2005, 2006, 2007 and 2008 and to provide for a one-time signing bonus of $200.00 per full-time employee and $100.00 for employees who are not full-time but who had completed 480 hours of service in 2004.

Manager of Building Inspections and Property –

2005 Agricultural Land Rentals

A memorandum dated November 30, 2004 from the Manager of Building inspections & Property was circulated for the consideration of Council.

That the Council of the City of Yorkton set the agriculture land lease rate at $24.00 per cultivated acre and $12.00 per acre of pasture or hay land for the 2005 crop year.

Residential Lot Inventory

A memorandum dated December 3, 2004 from the Building Services Department regarding residential lot inventory was circulated for the consideration of Council.

That the Council of the City of Yorkton approve the addition of ten lots, located on Poplar Bay, to the inventory of residential property for sale at the prices indicated therein.

Director of Finance – Outstanding Utility Accounts

A memorandum dated December 8, 2004 along with a list of write-offs from the Director of Finance were circulated for the consideration of Council.

That the Council of the City of Yorkton authorize Administration to write off the list of outstanding utility accounts totaling $7,815.59 for the year 2004 as attached to these minutes.

Councillor Wyatt inquired as to how the utility hook up rate could be increased by $100.00. Administration advised they would assist him in bringing this item forward to another Council Meeting.

Riverside Terrace Marketing Initiative {27.10(e)(i)(ii)(iii)(v)}

That we accept Recommendation No. C00088-2004 as contained in the Committee of the Whole Council Meeting Minutes of December 13, 2004 that the City of Yorkton approve an amendment to Policy 10.130 "Real Estate Commission and Referral Fees" allowing for the payment of commission fees of 3% to either Realtors or Builders, on residential lots available in Riverside Terrace only.

Councillors Arnelien, Maloney and Wyatt opposed.

That we accept Recommendation No. C00089-2004 as contained in the Committee of the Whole Council Meeting Minutes of December 13, 2004 that the City of Yorkton, after reviewing the proposals submitted, engage the Law Firm of Rusnak, Balacko, Kachur, Rusnak, S.G. Kyba, and that Wayne Rusnak be appointed City Solicitor for the years 2005, 2006 and 2007 respectfully.

Performance Feedback & Development Forms and Recommendations {27.10(f)(iii)(e)(i)(iv)(v)}

That we accept Recommendation No. C00090-2004 as contained in the Committee of the Whole Council Meeting Minutes of December 13, 2004 that the Performance Feedback and Development Forms and the Inclusive Leadership Project report dated December 6, 2004 be accepted as presented and that Administration commence using the forms as soon as possible for all employees.
