REGULAR COUNCIL MEETING MINUTES

JANUARY 10, 2005

 

Minutes of a Regular Meeting of Council held on Monday, January 10, 2005 in Council Chambers City Hall commencing at 5:00 p.m.

Present: Mayor Phil De Vos, Councillors Arnelien, Goulden, Hill, Maloney, Schmidt and Wyatt.

Staff Members Present: Wayne Jensen, Laurie-Anne Rusnak, Jeff Humble, Lonnie Kaal, Cindy Alcorn, Don Kunkel, Gord Bulmer, Darcy McLeod, Jillian Savage and Kelly Kaban. Recording: Gloria Signarowski.

A quorum being present Mayor Phil De Vos in the Chair called the Meeting to order at 5:00 p.m.

APPROVAL OF AGENDA

That the Agenda for this Regular Council Meeting be approved as presented.

PUBLIC ACKNOWLEDGEMENTS

Councillor Randy Goulden wished everyone "Happy New Year" in Ukrainian.

Councillor Hill wished everyone a "Happy New Year" and added that Wednesday is film night at the theatre and "Vanity Fair" is playing.

Councillor Schmidt congratulated Mr. Pat Koskie on his appointment as a Provincial Judge, and also our City Solicitor, Wayne Rusnak on his Queen’s Council appointment.

Mayor Phil De Vos thanked the Public Works Department for a job well done on the snow removal after the last storm. He congratulated the Centennial Committee on the successful kick off of the New Year with a party at the Legion and also the ringing of the bell at the museum. He advised that Sno Show is back and will be held on February 5th and 6th, 2005 with events in the downtown core and at the Gallagher Center. The Centennial Committee has a website with the events upcoming for the year. He also wanted to mention the parishioners at St. Gerard’s who will celebrate 100 years.

HEARING OF PETITIONS, PUBLIC NOTICES AND PRESENTATIONS

Public Notice – Bylaw No. 26/2004 – Property Standards Bylaw

Mr. Ted Deneschuk was present in Council Chambers to speak against the Property Standards Bylaw.

Mr. Tom Seeley was present in Council Chambers to speak in favour of the Property Standards Bylaw.

Public Notice – Bylaw No. 27/2004

- Business Improvement District (BID) Bylaw

There was no one present in Council Chambers to speak for or against Bylaw No. 27/2004, Business Improvement District (BID) Bylaw.

Tourism Yorkton – 2004 Annual Report

A letter dated December 6, 2004 along with the 2004 Annual Report were circulated for the consideration of Council.

Councillor Goulden declared a pecuniary interest regarding this item and left Council Chambers at 5:28 p.m.

Mr. Neil Thom, President of Tourism Yorkton was present in Council Chambers and gave a brief presentation regarding the 2004 Tourism Yorkton Annual Report.

Councillor Goulden returned to Council Chambers at 5:30 p.m.

 

Good Spirit REDA Inc. – 2004 Annual Report

Council was circulated with the 2004 Annual Report from the Good Spirit REDA Inc. dated January 10, 2005 along with an amendment.

Mr. Dick DeRyk was present in Council Chambers and gave a brief presentation regarding the report.

REPORTS OF COMMISSIONS, COMMITTEES AND MATTERS REFERRED

Partnership/Fundraising Committee – City of Yorkton Multipurpose

Family Leisure Centre and Arena Naming

A memorandum dated December 22, 2004 from Councillor Randy Goulden, Chairman of the Partnership/Fundraising Committee for the Family Leisure Centre was circulated for the consideration of Council.

Mr. Dave Farrell was present in Council Chambers and spoke to the memorandum. As well, Shauna Loy (Gallagher) and her daughter were also present in Council Chambers regarding the naming of the new facility.

That the Council of the City of Yorkton name the new multi-purpose Family Leisure Centre the "Gallagher Centre" for a period of ten years, and that the arena be named the "Farrell Agencies Arena" for a period of 10 years in recognition of the outstanding community spirit and contributions to this new facility from the Gallagher Family and Farrell Agencies.

A memorandum dated December 23, 2005 along with a list of Council Members appointments to Commissions were circulated for the consideration of Council.

A memorandum dated January 6, 2005 from Mayor Phil De Vos along with a list of the 2005 Members at large appointments to the 2005 Commissions of Council were circulated for the consideration of Council.

INTRODUCTION OF BYLAWS

Bylaw No. 26/2004 – Property Standards Bylaw

That Bylaw No. 26/2004, a Bylaw of the City of Yorkton in the Province of Saskatchewan to regulate property standards within the City of Yorkton be read a second time this 10th day of January A.D. 2005.

Councillors Maloney and Wyatt opposed.

Carried.***

It was suggested that Administration prepare a report regarding the composition of the Appeals Board prior to third reading of Bylaw No. 26/2003 as to what other cities are doing, and that this Bylaw be brought forward once the survey is complete.

Bylaw No. 27/2004 – Business Improvement District (BID) Bylaw

That Bylaw No. 27/2004 be amended in Schedule "A" to include 15 Agricultural Avenue, 60 Myrtle Avenue and 70 First Avenue North and read a second time this 10th day of January A.D. 2005.

That Bylaw No. 27/2004, a Bylaw of the City of Yorkton to designate an area in the Downtown and West Broadway corridor as a Business Improvement District and to establish a Board of Management thereof, as amended, be read a third time this 10th day of January A.D. 2005 and registered in the Bylaw Register of the City of Yorkton.

Code of Ethics Policy 10.30

A memorandum dated December 17, 2004 from the City Clerk/Director of Human Resources along with a draft Code of Ethics Policy 10.30 were circulated for the consideration of Council.

That the Council of the City of Yorkton amend the Code of Ethics Policy 10.30 by adding the following wording at the end of Section 5.(6)(c); Prizes randomly drawn for at the annual City of Yorkton Christmas Party and Appreciation Dinner are exempt from this provision.

That the Council of the City of Yorkton designate Mr. Brian Dudar, Parks Supervisor as the City of Yorkton’s Pest Control officer and Weed Inspector effective January 10, 2005 through to December 31, 2005.

Kittel Avenue Residential Subdivision

A memorandum dated January 5, 2005 from the Junior Planner regarding a residential subdivision along with pertinent background information were circulated for the consideration of Council.

That the Council of the City of Yorkton recommends approval to the Province of Saskatchewan – Community Planning for the proposed subdivision application for the SE Ό 4-26-4 (Pleasant Heights), as it complies with the Yorkton Planning District Development Plan Bylaw No. Z1-94 and the Yorkton Planning District Zoning Bylaw No. Z2-94.

A memorandum dated December 30, 2004 from Mayor Phil De Vos concerning travel expenses for Councillor Wyatt was circulated for the consideration of Council.

That the Council of the City of Yorkton allow out of Province travel expenses for Councillor Christ Wyatt to participate in the Last Cattle Frontier as the City of Yorkton’s representative, from January 17 to 21, 2005 in Alberta.

A memorandum dated December 15, 2004 from Councillor Chris Wyatt regarding the Waterworks Utility Bylaw No. 10/2003 was circulated for the consideration of Council.

CPR crossing – Downtown Redevelopment Plan

That we accept Recommendation No. C00003-2005 as contained in the Committee of the Whole Council Meeting Minutes of January 10, 2005 that Council direct Administration to draft a letter to the Canadian Pacific Railway (CPR) requesting a grade level crossing on Livingstone Street between Fourth Avenue North and Third Avenue south, and that the City offer CPR the close of the Maple Avenue Crossing.

Gallagher Centre (Family Leisure Centre) Roof Structure

That we accept Recommendation No. C00004- 2005 as contained in the Committee of the Whole Council Meeting of January 10, 2005 that the City of Yorkton go with the steel structure for the roof at the Family Leisure Centre (Gallagher Centre) rather than the wood structure based on the information provided.
