REGULAR COUNCIL MEETING MINUTES

OCTOBER 31, 2005

 

Minutes of a Regular Council Meeting held on Monday, October 31, 2005 in Council Chambers City Hall commencing at 5:00 p.m.

Present: Mayor Phil De Vos, Councillors Arnelien, Goulden, Hill, Maloney, Schmidt and Wyatt.

Staff Members Present: Darcy McLeod, Laurie-Anne Rusnak, Lonnie Kaal, Jeff Humble, Bonnie Schenher, Kelly Kaban and Gord Bulmer. Recording: Gloria Signarowski.

A quorum being present Mayor Phil De Vos in the Chair called the meeting to order at 5:00 p.m.

APPROVAL OF AGENDA

That the Agenda be amended by removing Bylaw No. 28/2005 – Borrowing Bylaw under Introduction of Bylaws.

PUBLIC ACKNOWLEDGEMENTS

Councillor Maloney advised of an article on Yorkton in the Leader Post in the October 27th, 2005 entitled Bronfman’s Bootleggers and Peanut trains. It has great information on the City of Yorkton and it’s history.

Councillor Hill thanked Mrs. Diane Rusnak and the Health Foundation Committee for putting on the Gala for the 10th year in a row, which was in conjunction with the RCMP Ball.

Councillor Arnelien wished all residents a safe and happy Halloween.

Councillor Goulden advised that the City of Yorkton hosted the SPRA Conference two weeks ago and on that evening the Gallagher Centre received an Award of Excellence for facilities in the Province of Saskatchewan.

Councillor Schmidt wanted to welcome a famous Saskatchewan photographer, Courtney Milne to our City sharing his scenes of Saskatchewan at the Public Library on Wednesday, November 2nd, 2005 at 7:00 p.m.

Mayor Phil De Vos advised that City Council has selected a new City Manager to replace Mr. Wayne Jensen due to his retirement. Mr. David Putz will commence employment on November 28, 2005. Mayor Phil

De Vos provided a biography of Mr. Putz and a brief news release on the process that took place.

HEARING OF PETITIONS, PUBLIC NOTICES AND PRESENTATIONS

Public Notice – Discretionary Use Application – Building Materials Sales and Storage Yard – 127 Smith Street East

Ms. Joanne Bast was present in Council Chambers and made a presentation to City Council requesting that Council deny the request for the discretionary use at 127 Smith Street East.

Ms. Kerry Geddes, owner of "Welcome Home Crafts" located at 113 Smith Street East was also present to make a presentation requesting that Council deny the discretionary use at 127 Smith Street East.

Mr. Bryce Sherring also was present in Council Chambers and read a letter from Sharon Dombroski, the owner of "The Hair Cottage" located at 123 Smith Street East, also asking Council to deny the discretionary use at 127 Smith Street East. Several letters expressing concern with respect to this application were circulated for Council’s information.

The Royal Canadian Legion – Proclamation – Veterans Week –

November 4th to 11th, 2005.

A letter dated October 3, 2005 from the Royal Canadian Legion was circulated for the consideration of Council.

Mr. Edward St. Pierre, President, and Ms. Linda McCulough, Poppy Chairman were present in Council Chambers. Mr. St. Pierre spoke to their request.

That the Council of the City of Yorkton authorize Mayor Phil

De Vos to proclaim the week of November 5th to 11th, 2005 as "Veteran’s Week" in the City of Yorkton and to have a flag raising ceremony on Saturday, November 5th , 2005 at 10:00 a.m. at City Hall Park.

That the one-year RCMP Clerk Steno contract term position for 2005 be designated as a full-time position effective January 1, 2006 subject to the position being classified within the current salary grid and that the RCMP request for two additional Clerk Steno’s be referred to the 2006 Budget deliberations.

Bylaw No. 29/2005 – Exemption of Taxes – 345 Broadway Street West

That Bylaw No. 29/2005, a bylaw of the City of Yorkton to provide for the exemption of taxation for certain properties (345 Broadway St. West) within the City of Yorkton be introduced and read a first time this 31st day of October A.D. 2005.

Discretionary Use Application – Building Materials Sales and Storage Yard – 127 Smith Street

A memorandum dated October 7, 2005 from the Director of Planning and Engineering regarding a discretionary use application at 127 Smith Street East was circulated for the consideration of Council.

That we accept Recommendation No. C00088-2005 as contained in the Committee of the Whole Council Meeting Minutes of October 31, 2005 that the Council of the City of Yorkton authorize the execution of an agreement for the sale of the Fifth Avenue Parking Lot (22 Fifth Avenue, Lot 7 & 8, Block 4, Plan No. 20767) to Mr. Gasteiger of Yorkton Fireplaces and Patios for the sum of $20,000, with the following conditions: (1) a portion of the $20,000 be reallocated to resurface the laneway between Fourth and Fifth Avenue, (2) the sidewalk be replaced, (3) the trees in front be considered for removal and replacement at the City’s expense, and (4) subject to Mr. Gasteiger burning only seasoned firewood and to ensure that any noxious substances are not created from his place of business.

That we accept Recommendation No. C00089-2005 as contained in the Committee of the Whole Council Meeting Minutes of October 31, 2005, that subject to Sections 262 and 263 of The Cities Act, the Council of the City of Yorkton direct Administration to prepare a bylaw to grant Integrated Life Care Inc. an annual tax abatement to February 1, 2007 for the old Sacred Heart School for the construction of approximately fifty care beds and twenty supported living units.

That we accept Recommendation No. C00090-2005 as contained the Committee of the Whole Council Meeting that the City of Yorkton subsidize Premier Cabinets to a maximum of $7,500 (including additional expenses relating to winter costs), for the installation of a 1" water and 6" gravity sewer line, and that this project be an over- expenditure on the Sewer and Water Connections Custom Work (Account #925065) with the owner to pay $8,500.

1.d. Director of Finance Gallagher Centre – Borrowing Proposals [27.20(e)(i)(iii)&(f)(iv)(v)]

That we accept Recommendation No. C00091-2005 as contained in the Committee of the Whole Council Meeting Minutes of October 31, 2005 that Council authorize the Director of Finance to proceed to accept the proposal from the Toronto Dominion Bank and make arrangements to borrow $5,000,000 over 15 years, and to bring back a bylaw in this regard.
