November 27, 2006

Minutes of a Regular Meeting of Council held on Monday, November 27, 2006 in Council Chambers City Hall commencing at 5:00 p.m.

Present: Mayor Chris Wyatt, Councillors Arnelien, DeRyk, Goulden, Maloney, and Wilson.

Absent: Councillor Larry Pearen.

Staff Members Present: David Putz, Laurie-Anne Rusnak, Lonnie Kaal, Darcy McLeod, Dean Clark, Kelly Kaban, Bonnie Schenher, Fran Brimacombe, Michael Buchholzer, Don Kunkel, Stu McFadyen, and Cindy Alcorn. Recording: Gloria Signarowski.

A quorum being present Mayor Chris Wyatt in the Chair called the meeting to order at 5:00 p.m.

APPROVAL OF AGENDA

PUBLIC ACKNOWLEDGEMENTS

Councillor Goulden congratulated the Yorkton Speed Swim Club for hosting a successful swim meet with 89 swimmers from The Pas and Dauphin, Manitoba and Moose Jaw and Regina.
Mayor Chris Wyatt advised that he was honored to bring greetings to the World Curling tour which brought hundreds of people to our city and it is a very exciting event. On a sad note, he expressed condolences to Councillor Larry Pearen and his family on the passing of his Father.

Presentation – Fire Services Exemplary Service Medals

Mayor Chris Wyatt circulated a report dated November 21, 2006 regarding the Fire Services Exemplary Service Medal.
He presented Fire Chief Dean Clark with the Fire Services Exemplary Service Medal and certificate for completing 20 years of service with the Fire Services.

Presentation – Bernard Stephaniuk – Nuisance and Obnoxious Smoke

A letter dated November 22, 2006 from Mr. Bernard Stephaniuk regarding a follow-up to his previous presentation made on November 6, 2006 was circulated for the consideration of Council.
Mr. Stephaniuk was present in Council Chambers to speak to his concerns and filed more information for Council’s consideration. He also advised that another letter is being signed by other concerned parties which he will provide tomorrow regarding the issue of the nuisance and obnoxious smoke.

-Nuisance and Obnoxious Smoke

A letter dated November 22, 2006 from Mr. Ralf Gasteiger of Fireplaces and Appliances Ltd. regarding a presentation to Council on the issue of wood burning was circulated for the consideration of Council.
Mr. Gasteiger was present in Council Chambers and spoke to his letter. He advised that he has had his premises inspected by the Deputy Fire Chief, the Manager of Building Services and the Department of Environment, is complying with all of their requests and is burning only birch or tamarack.

Public Notice – Discretionary Use Application – 582 Circlebrooke Drive

There were no petitioners present in Council Chambers to speak for or against the discretionary use application for a four unit dwelling for Lot 1, Block 50, Plan 64Y00483, 582 Circlebrooke Drive.

A report dated November 20, 2006 from the Assistant City Clerk regarding a school division by-election along with a letter dated November 8, 2006 from Christ the Teacher R.C.S.S.D. No. 212 were circulated for the consideration of Council.

That the by-election of Christ the Teacher R.C.S.S.D. No. 212 for one Board Member from the City of Yorkton at large, be held on January 31, 2007, and that we approve the request of the School Division to have Bonnie Schenher appointed as the Associate Returning Officer for this by-election.

Yorkton Citizens on Patrol Program – 2007 Request for Funding

A letter dated November 6, 2006 from the President of COPP regarding a request for funding for 2007, along with their financial statement for the period January 1, 2005 to December 31, 2005 were circulated for the consideration of Council.

-Building Inspection Services for the Proposed Canola Crushing Facility

A report dated November 21, 2006 from the Manager of Building Services along with a request for proposal submission were circulated for the consideration of Council.

That the attached proposal be accepted and a contract between Professional Building Inspections Inc. and the City of Yorkton be entered into providing inspection services for the proposed canola crushing plant to be located at S½ 9-26-4-2 at a cost not to exceed $3.30/$1,000 value of construction plus GST.

-Leadership Development Program

A report dated November 1, 2006 from the City Clerk/Director of Human Resources regarding a Leadership Development Program was circulated for the consideration of Council.

That the City proceed to offer the University of Regina Leadership Program to 25 employees in positions requiring excellent leadership skills; utilizing $11,000 from the 2006 budget, $14,000 from grant funding and earmarking $25,000 from the 2007 budget. And further, that the City partner with the Parkland Regional College to provide for ongoing leadership development.

Director of Leisure Services – Skate Park Location

A report dated November 15, 2006 from the Director of Leisure Services regarding the skate park location was circulated for the consideration of Council.
The Chair was passed to the Deputy Mayor at 5:50 p.m.

That Council support the Leisure Services Commission recommendation and further authorize administration to present the Leisure Services Commission recommendation, which is to locate the Skate Park in the southwest corner of the Gallagher Centre parking lot, to the Gallagher Centre Management Board, local businesses and the participants with the results of the input to be presented to Council at the first Council Meeting in February of 2007.
Mayor Chris Wyatt opposed.

Director of Finance – SIGN – Tax Abatement

A report dated November 20, 2006 from the Director of Finance regarding a request for tax abatement from SIGN along with pertinent background information were circulated for the consideration of Council.

That Administration prepare a bylaw abating 10/12’s of the taxes for the SIGN building at 345 Broadway Street West for the 2006 year. Further that SIGN be advised that the building will be taxable in 2007.

- Industrial Sask Power 10% Surcharge

A report dated November 9, 2006 from the Director of Finance regarding the Industrial Sask Power 10% Surcharge Rebates Policy along with pertinent background information were circulated for the consideration of Council.

A report dated November 20, 2006 from the Director of Finance regarding T.A. Packaging Ltd. along with a letter dated September 12, 2006 from TA Foods Ltd. and a copy of the Enterprise Zone Incentive Policy were circulated for the consideration of Council.

Mr. Terry Popowich was present in Council Chambers to answer any questions.

That a tax abatement bylaw be brought forward by Administration abating taxes on existing land and improvements for the property known as 120/138 Myrtle for 10/12’s in 2006. Further, consideration of the request to phase-in taxes in future years be deferred pending a review of the existing incentive policy.

Engineering Assistant – Discounted Bus Pass Pilot Program

A report dated November 21, 2006 from the Engineering Assistant regarding a discounted bus pass pilot program along with a draft Letter of Understanding were circulated for the consideration of Council.

12-month period.

Potential Lease of Council Chambers to SPM

A report dated November 23, 2006 from the Manager of Building Services was presented for the consideration of Council.

That Administration negotiate an agreement with Saskatchewan Property Management for January, February and March 2007, for use of the Council Chambers for Provincial Court, keeping in line with the discussions that were stated tonight regarding janitorial supplies and service, leaving the space in the same condition as it was prior to the Provincial Court taking over, ensuring that Council Chambers is set up in the appropriate condition for the Council Meetings, any damages to the building or property be at SPM’s cost, and that Administration amend the policy for use of Council Chambers accordingly.
Councillor Maloney opposed.

O/A Urban County Dodge Chrysler Jeep as contained in the agreement dated July 15, 2003, to Yorkton Dodge be approved.
