JANUARY 22, 2007

Minutes of a Regular Council Meeting held on Monday, January 22, 2007 in Council Chambers City Hall commencing at 5:00 p.m.

Present: Deputy Mayor Les Arnelien, Councillors DeRyk, Maloney, Pearen and Wilson.

Absent: Mayor Chris Wyatt and Councillor Randy Goulden.

Staff Members Present: David Putz, Laurie-Anne Rusnak, Roger Hunter, Darcy McLeod and Michael Buchholzer. Recording: Gloria Signarowski.

A quorum being present Deputy Mayor Les Arnelien in the Chair called the meeting to order at 5:00 p.m.

HEARING OF PETITIONS, PUBLIC NOTICES AND PRESENTATIONS

Heart and Stroke Foundation of Saskatchewan – Proclamation – Heart and Stroke Month – February 2007

A letter dated November 9, 2006 from the Campaign Coordinator of the Heart and Stroke Foundation of Saskatchewan was circulated for the consideration of Council.
Ms. Kerry Bartake, Campaign Coordinator was present in Council Chambers to speak to their request.

That the Council of the City of Yorkton authorize Mayor Wyatt to proclaim the month of February as “Heart and Stroke Month” in the City of Yorkton.
Carried.***

Administration was requested to look into putting the Heart and Stroke banner across Broadway.

Donna Brothwell – Smoking Bylaw No. 38/2003 Enforcement

A letter received from Donna Brothwell regarding concerns about students smoking at the Yorkton Regional High School was circulated for the consideration of Council.

Donna Brothwell spoke to her concerns.

That Council refer the request for enforcement of Smoking Bylaw No. 38/2003 to Administration for a detailed report on the current status and jurisdiction (at the Yorkton Regional High School), and to report back to Council within the next 30 days.
Councillor Bob Maloney opposed.

REPORTS OF COMMISSIONS, COMMITTEES AND MATTERS REFERRED

Mayor Wyatt – 2007 Commissions of Council Appointments

A memorandum dated January 9, 2007 from Mayor Wyatt along with a list of the 2007 Commission of Council Appointments were circulated for the consideration of Council.

That the 2007 Commissions of Council Appointments be amended by deleting Dianne Holfeld, Madeleine Lange and Conrad Rodney from the Municipal Planning Commission – Municipal Heritage Sub-Commission.

Councillor DeRyk opposed.
Carried.***

Councillor DeRyk commented that the whole system of Commissions of Council needs to be reviewed and that he would draft some information for a future Council Meeting.

ADMINISTRATIVE REPORTS

Director of Leisure Services – 2007 Pest Control Officer, Weed Inspector & SERM Municipal Inspector Appointments

A report dated January 9, 2007 from the Director of Leisure Services regarding the 2007 Pest Control Officer, Weed Inspector & SERM Municipal Inspector Appointments was circulated for the consideration of Council.

That Council appoint Brian Dudar, Parks and Arena Manager as the SERM Municipal Inspector under the Forest Resources Management Act, Weed Inspector under the Noxious Weeds Act, 1984 and the Pest Control Officer under the Pest Control Act, for 2007.

ABS Contract Amendments

A report dated January 11, 2007 from the Director of Leisure Services along with a letter dated January 12, 2007 from Mr. Al Sauser were circulated for the consideration of Council.

That Council approve the following amendments to the ABS Golf Management Contract: Remove Section 17.11 of the contract in its entirety, replace “90 days” with “nine (9) months” in Sections 20.1.2, 20.2 and 20.3 and change Section 20.4 to the following: “it is agreed that should termination proceedings be enacted, the City shall guarantee the transfer or sale of all material/merchandise, with the Deer Park logo as well as all items outlined in Schedule “B” and “C” at fair market value. If required, a mutually acceptable arbitrator may be used to determine the fair market value of these items.

Leisure Services 2007 to 2009 Fees and Charges

A report dated January 12, 2007 from the Director of Leisure Services regarding the 2007 to 2009 fees and charges for use of city facilities was circulated for the consideration of Council.

That the 2007 – 2009 Leisure Services fees and charges schedule be approved as presented.
Carried.***

Council requested a historical statement depicting cost recovery of Leisure facilities.

Director of Planning & Engineering – Country Residential Subdivision Application – R.M. of Orkney No. 244 (SW ¼ 24-26-4-W2nd – Peter and Judy Sawchuk)

A report dated January 18, 2007 from the Director of Planning and Engineering, along with pertinent background information regarding a country residential subdivision application were circulated for the consideration of Council.

That the proposed Peter and Judy Sawchuk country residential subdivision of the SW ¼ 24-26-4-W2nd be approved subject to the Province satisfying itself that the lot will be legal conforming.

City Manager – Assiniboine Watershed Stewardship Association Inc. Membership

A report dated January 19, 2007 from the City Manager along with pertinent background information on the Assiniboine Watershed Stewardship Association Inc. were circulated for the consideration of Council.
Mr. Rob Kirkness and Mrs. Janet Hill representatives from the Assiniboine Watershed Stewardship Association Inc. were present in Council Chambers to answer any questions.

That membership in the Assiniboine Watershed Stewardship Association Inc. be approved for two years with the third year being conditional upon continued funding being provided by the Saskatchewan Watershed Authority; and that the membership fee be $3,000 per annum plus the provision of office space, provided the office space is not required for City operations.

City Clerk/Director of Human Resources – Leadership Development Program

A report dated January 19, 2007 from the City Clerk/Director of Human Resources along with a copy of the Education and Training Policy 30.30 regarding the Leadership Development Program, were circulated for the consideration of Council.

That Council accept Option #1 that the provisions of Section 3.4 Employee Commitment of the Education and Training Policy 30.30 be waived for the Leadership Development Certificate Program to ensure complete participation by City employees.
Councillors Pearen and Wilson opposed.
