MARCH 5, 2007

Minutes of a Regular Meeting of Council held on Monday, March 5, 2007 in Council Chambers City Hall commencing at 5:00 p.m.

Present: Mayor Chris Wyatt, Councillors Arnelien, DeRyk, Goulden, Maloney, Pearen and Wilson.

Staff Members Present: David Putz, Laurie-Anne Rusnak, Lonnie Kaal, Roger Hunter, Darcy McLeod, Don Kunkel, and Cindy Alcorn.
Recording: Gloria Signarowski.

A quorum being present Mayor Chris Wyatt in the Chair called the meeting to order at 5:00 p.m.

APPROVAL OF AGENDA

Goulden – Wilson
That the Council Agenda be amended by adding one property item as No. 1 in the in-camera portion of the Committee of the Whole Council Agenda and moving the existing No. 1 on the Agenda to No. 2, as well as adding a presentation from the Chamber of Commerce under Hearing of Petitions to the Regular Agenda and that the Regular Council and the Committee of the Whole Council Agendas be approved as amended.
Carried.***

PUBLIC ACKNOWLEDGEMENTS

Councillor Maloney advised that the 30th Snowarama event, a Provincial Fundraiser raised $110,000.00 for Camp Easter Seal and was coordinated by Yorkton Snowriders Club. He thanked the volunteers for a great job done.

Councillor Goulden advised she was in Wintook Namibia Africa with the Federation of Canadian Municipalities where she toured a water reclamation plant. All the water that is used for domestic or commercial use is reclaimed effluent that goes through a vigorous treatment project, every drop is reclaimed.

Mayor Wyatt congratulated the Saskatchewan Wildlife Federation who brought in over 200 delegates to the City for their convention. He also asked the citizens of Yorkton to be patient with our snow removal rating our City as second to none for snow removal and clearing.

That Resolution No. C00012-2007 as contained in the Special Committee of the Whole Council Meeting Minutes of Monday, February 26, 2007 that CN’s request for an option for the 9 acres as requested on the condition that CN bear the cost of relocating the Parkland Racing Association Racetrack be denied; and further that CN be requested to establish a right of way from the existing CN track that would align with the northern boundary of SW ¼ 10-26-4.

HEARING OF PETITIONS, PUBLIC NOTICES AND PRESENTATIONS

Yorkton Youth Advisory Council (YAK) – Request for Exemption under the Noise Bylaw No. 21/99

A letter dated March 1, 2007 from the Yorkton Youth Advisory Council regarding a request under the Noise Bylaw No. 21/99 was circulated for the consideration of Council.
Ms. Brittany Osicki and Mr. Andrew Conon representatives from the Youth Advisory Council were present in Council Chambers and Ms. Osicki spoke to their request.

That the Yorkton Youth Advisory Council be exempt from Bylaw No. 21/99 (Noise Bylaw) on March 31, 2007 from 6:00 p.m. to 12:30 p.m. to hold a concert for six local bands located at 31 Foster Street.
Carried.***

Councillor DeRyk asked that the neighbours be advised of this event, just as a courtesy.

Canadian Cancer Society – Proclamation – “April as Cancer Awareness Month”

A letter dated February 21, 2007 from the Canadian Cancer Society requesting a proclamation was circulated for the consideration of Council.
Mr. Murray Williams, President was present in Council Chambers to speak to their request.

That the Council of the City of Yorkton authorize Mayor Chris Wyatt to proclaim the month of April as “Cancer Awareness Month” in the City of Yorkton and to raise their flag on Monday, April 2, 2007 at 10:30 a.m. at City Hall Park.

Yorkton Chamber of Commerce – President

Mr. Rick Schrader, President of the Yorkton Chamber of Commerce, was present in Council Chambers to provide information from the downtown businesses on the skateboard park location. Mr. Schrader advised that the Chamber of Commerce had done a survey of the downtown businesses regarding the skateboard park being located on the corner of Smith Street and Betts Avenue. They had 66 members vote, 49 on line and 17 by email, 37 members voted no to the downtown location, 9 members voted for neither location and 21 members voted for the downtown area location. 1% were actually from the downtown area itself the other 37 members who voted for the Gallagher Centre, 95% were from the downtown area. Main concerns were parking, vandalism, and user groups. The business people didn’t think it was a positive step to locate the skate park downtown. As far as spending, 60% said the budget should be up to $75,000, 21% indicated the budget should be $75,000 to $100,000.

Mayor Wyatt – Amendments to the 2007 Commissions of Council Appointments

A memorandum dated February 27, 2007 from Mayor Chris Wyatt regarding amendments to the 2007 Commissions of Council was circulated for the consideration of Council.

That Council amend the 2007 Commissions of Council appointments by adding Mr. Terry Ruf to the Municipal Planning Commission as the representative for the Yorkton Roman Catholic Separate School Division, and add Mr. Al Drul to the Yorkton Housing Corporation for the year 2007; and further that the Terms of Reference for the Solid Waste Management Committee be amended to add one additional Member at large providing for (11) members in total; that Raymond Sass be appointed as a Member at Large to the Solid Waste Management Committee and the Protective Services Commission and be exempted from the residency requirements.

Bylaw No. 1/2007 – Amend Smoking Bylaw No. 38/2003

That Bylaw No. 1/2007, a bylaw of the City of Yorkton to amend Bylaw No. 38/2003, regulating smoking in public places and workplaces within the City of Yorkton be introduced and read a first time this 5th day of March A.D. 2007.

Municipal Planning Commission – Zoning Bylaw Review Sub-Commission

A report dated February 26, 2007 from the City Manager to establish a committee to review Zoning Bylaw No. 14/2003 was circulated for the consideration of Council.

Manager of Building Services – Cash Back policy No. 10.40

A report dated February 23, 2007 from the Manager of Building Services regarding Cash Back Policy No. 10.40 was circulated for the consideration of Council.

That the ½ cash back incentive be applied to the sale of infill properties for: 155 & 159 Ontario Avenue, 221 Betts Avenue, 100 Victoria Avenue, 294 Victoria Avenue, 310 Victoria Avenue, 316 Victoria Avenue, 320 Victoria Avenue, and 95 Darlington Street West as was previously established in Cash Back Policy No. 10.40 that expired on December 31, 2006, and that the purchase agreements related to these properties be duly executed subject to the standard terms and conditions.

Director of Leisure Services – Skate Park Location

A report dated February 26, 2007 from the Director of Leisure Services along with extensive pertinent background information regarding the skate park location were circulated for the consideration of Council.

That Council authorize Administration to place the skate park on the southwest corner of the Gallagher Centre parking lot.

UNFINISHED BUSINESS

Voting on Postponed Motion No. R00037(a)-2007 from the Regular Council Meeting of February 12, 2007 – Repayment Options Gallagher Centre Grant Money

The Director of Finance advised that she had not had sufficient time to prepare a report with respect to Motion No. R00037(a)-2007. It was the consensus of Council that they had received sufficient feedback from the residents and were prepared to vote on Motion No. R00037(a)-2007 without further postponement.

That the proceeds of the reduced interest cost as a result of the lump sum internal loan payment, be applied to reduce the base tax, in a proportionate amount that was originally levied for the Gallagher Centre.

Motion defeated.***
