March 17, 2008

Minutes of a Regular Meeting of Council held on Monday, March 17, 2008 in Council Chambers City Hall commencing at 5:00 p.m.

Present: Mayor Chris Wyatt, Councillors Arnelien, DeRyk, Goulden, Maloney, Pearen and Wilson.

Staff Members Present: David Putz, Bonnie Schenher, Lonnie Kaal, Roger Hunter, Michael Buchholzer, Fran Brimacombe, Darcy McLeod, Dean Clark, Dennis Woroschuk, Don Kunkel and Trent Mandzuk. Recording: Gloria Signarowski.

A quorum being present Mayor Wyatt in the Chair called the meeting to order at 5:00 p.m.

APPROVAL OF AGENDA

PUBLIC ACKNOWLEDGEMENTS

Councillor DeRyk acknowledged the achievements of the Yorkton Terriers this season. Their season is finished and lost to Melville but the Terriers had a decent season and he congratulated Coach Zawatsky and the executive, players and many volunteers. The Terriers have a long history in this community and thanked them for a winter of sports and entertainment. The Brier finished this weekend and while the Saskatchewan team was officially from Davidson, there were three players on the team who have strong Yorkton and area connections. Congratulations to the Saskatchewan Team.

Councillor Goulden recognized the Yorkton Exhibition Association this past weekend as they brought in the SAASE conference of Saskatchewan Agricultural Societies and they were meeting for the weekend. Congratulations to Don Kunkel who is the Vice-President of the Saskatchewan Association of Agricultural Societies and Exhibitions.

Councillor Wilson advised of the Yorkton Celebrate Success awards that took place on March 12, 2008 hosted by the Chamber of Commerce. He congratulated every business that was nominated for an award, and acknowledged the great job done by Councillor Maloney and the President of the Chamber, Lori Walsh in emceeing. He congratulated the “Business of the Year” Maple Farm Equipment.

Mayor Chris Wyatt congratulated The Yorke Inn for receiving the “Restoration Award”, which is sponsored by the City of Yorkton.

Councillor Pearen advised that 90+ individuals from the Yorkton Regional High School will be traveling to Florida during the Easter break. The band will be performing at Disney World and the Kennedy Space Centre. He wished them all well as great ambassadors for the City of Yorkton.

INTRODUCTION OF BYLAWS

Bylaw No. 15/2007 – Urban Forestry Bylaw Amendment [3rd reading]

That Bylaw No. 15/2007, Section 8.3.5 and 8.3.6 and 8.37 be amended to read :

8.3.5 The reforestation fee shall be set at a maximum of twenty percent (20%) of the appraised value of the tree with a minimum reforestation fee set at $500.00.
8.3.6 The complainant/property owner shall be solely responsible for the cost of removal and remediation of the site as prescribed by the City of Yorkton.
8.3.7 The complainant/property owner shall be informed, by way of being provided a Tree Removal Permit (Appendix E) from the Parks Branch that he/she shall be responsible to pay to the City the reforestation fee prior to removal. The estimated costs associated to the removal and remediation shall be provided at the time, however the property owner is responsible to pay for the actual costs associated to the removal and remediation once completed.

Bylaw No. 1/2008 – “The Village” Street and Laneway Closure Amendment [3rd reading]

Bylaw No. 3/2008 – Amend Zoning Bylaw No. 14/2003 – Implementing Architectural Controls and Design Guidelines for Riverside Terrace Subdivision

Architectural Controls Riverside Terrace

Discussion was held on the restrictions of garages Section 9.2.8. a) vii with the restrictions only applying if the garage must be flush with the front; vi. Solar panels and skylights, g) boats, tent trailers covered or tarped; brick façades; 9.2.8 iv. Council requested that the above bylaw be changed to remove the restrictions on solar panels and skylights.
Council requested that more research be done on this bylaw and that it be brought forward to the next Council meeting with suggested recommendations.

Bylaw No. 4/2008 – Amend Zoning Bylaw No. 14/2003 – Remove Registered Mail Requirements

Given that this building on 161 Dominion Avenue is adjacent to the “Enterprise Zone” and has been vacant for over one year, that the property be considered to qualify under the vacant property tax section of the Enterprise Zone Incentive Policy and receive 100% tax abatement for 2009 and 50% tax abatement for 2010 and full taxes in 2011 be lifted from the table.
