NOVEMBER 23, 2009

Minutes of a Regular Council Meeting held on Monday, November 23, 2009 in Council Chambers City Hall commencing at 5:00 p.m.

Present: Mayor James Wilson, Councillors Arnelien, Fisher, Maloney, Okrainec, Pearen and Wyatt.

Staff Members Present: David Putz, Bonnie Schenher, Lonnie Kaal, Michael Eger, Fran Brimacombe, Dennis Karakochuk, Darcy McLeod, Faisal Anwar and Don Kunkel. Recording: Gloria Signarowski.

A quorum being present Mayor James Wilson in the Chair called the meeting to order at 5:00 p.m.

APPROVAL OF AGENDA

That the Regular Meeting of Council Agenda and Committee of the Whole Council Meeting Agenda be approved as presented.

That the Regular Council Meeting Agenda be amended by deleting Sunrise Health Region – Physician Recruitment Issues under No. 4, Hearing of Petitions, Public Notices and Presentations, and adding Rider Pride Week under No. 9, Giving Notice of Motion.

PUBLIC ACKNOWLEDGEMENTS

Councillor Maloney reminded the citizens of Yorkton that the Salvation Army will be launching their Christmas Kettle Campaign on December 4, 2009. They had a great presentation from the Salvation Army at the Mayor’s Prayer Breakfast last week and the need is immeasurable. Their food bank requests are up 55% this year. He asked the citizens to please get out and support their campaign. They do a lot of great work in our community.

Councillor Arnelien congratulated Mr. Barry Sharpe on being selected as the final Torch Bearer who will light the cauldron during the Olympic Torch Relay at the Yorkton Community Celebration on January 9, 2010. Please come out, it will be a great event.

Councillor Okrainec advised that the Councillors had an opportunity to attend the Harvest Showdown held last week. It was another great event for Yorkton and he congratulated all the staff and volunteers at the Yorkton Exhibition Association.

Shelwin House – Proclamation – Battered Women’s Awareness Week – November 29th to December 6th, 2009

A letter dated November 6, 2009 from Yorkton Women In Need regarding a proclamation was circulated for the consideration of Council.
Ms. Lavern Dumka, Director and Ms. Laura Krawetz, Outreach Worker from Yorkton Women In Need were present in Council Chambers to speak to their request.

A report dated November 20, 2009 from Mayor James Wilson regarding appointments to the Agriplex Management Board was circulated for the consideration of Council.

That in accordance with Section 1, Paragraph 2 of the Agreement between the City of Yorkton and the Yorkton Agricultural and Industrial Exhibition Association Limited dated March 27, 2002 that Mayor James Wilson, Councillors Bob Maloney, Richard Okrainec, Larry Pearen and Chris Wyatt be appointed with Councillors Les Arnelien and Ross Fisher as alternates.

Director of Finance – Utility Account Write-off’s for 2009

A report dated November 9, 2009 from the Director of Finance regarding utility account write-off’s for 2009 was circulated for the consideration of Council.

That Administration be authorized to write off the attached list of outstanding utility accounts totaling $4,690.47 for 2009 and further than an annual report commencing in 2010 be provided for Council’s information which details all City account write-off’s incurred during that fiscal year; including but not limited to:
a) Building permits, Business Licenses, and Planning and Engineering accounts
b) Leisure accounts including Deer Park and Facility leases.
c) Gallagher Centre accounts for all services and rentals
d) Public Works and Waterworks accounts regarding custom work
e) Utility Billing and Tax accounts
f) Administration accounts including mobile home park and all general leases
g) Land Fund accounts including leases

Utility Account Write-off – 2008 Commercial Account

A report dated November 9, 2009 from the Director of Finance regarding a utility account write-off for a 2008 Commercial Account was circulated for the consideration of Council.

A report dated November 17, 2009 from the Director of Finance regarding a utility account write-off for 2008 Commercial Account was circulated for the consideration of Council.

Tax Arrears – 120 Livingstone Street

A report dated November 6, 2009 from the Director of Finance regarding tax arrears at 120 Livingstone Street along with a request to begin the advertising process for removal of the Municipal Heritage Designation was circulated for the consideration of Council.

That given that the original Municipal Heritage status was granted on the premise that the building known as the Kent Flour Mill continue to operate as a mill, and since the building has been vacant for 12 years and is in a state of disrepair; that notice of Council’s intent to remove the heritage status at the Council Meeting of January 11th, 2010 be published in the newspaper and that the Heritage Committee and all parties be advised in accordance with the requirements of The Heritage Property Act.

Manager of Engineering – Discounted Bus Pass Program

A report dated November 16, 2009 from the Manager of Engineering regarding the Discounted Bus Pass Program was circulated for the consideration of Council.

A report dated November 18, 2009 from the Manager of Engineering regarding a roadway right-of-way acquisition from Cowessess First Nation was circulated for the consideration of Council.

A report dated November 18, 2009 from the Planner regarding a discretionary use application No. 38-09 at 165 and 171 Broadway Street East was circulated for the consideration of Council.

A report dated November 19, 2009 from the Planner regarding revisions to the Condominium Conversion Policy No. 10.240 was circulated for the consideration of Council.

That the proposed revisions to the Condominium Conversion Policy No. 10.240, which establishes the requirements and criteria for the conversion of residential rental units to condominium ownership, be adopted. Further, that all current condominium conversion applications be reviewed in accordance with Condominium Conversation Policy No. 10.240, as amended.

That we accept Recommendation No. C00092-2009 as contained in the Committee of the Whole Council Meeting Minutes of November 23, 2009 that a counter offer be made at $130,000 on condition apartment construction commence in 2010 with an additional payment of $19,000 being due if construction is not started prior to November 2, 2010 and if the project is not for rental units, they would also pay the $19,000 subject to Public Notice Requirements.

That we accept Recommendation No. C00095-2009 as contained in the Committee of the Whole Council Meeting Minutes of November 23, 2009 that we offer the same financial package as the Board awarded in Swift Current if there is no change in Swift Current’s order, pay 5X Agriculture/Residential taxes upon issuance of the order. Make 10 Annual payments equal to 15X Commercial taxes with the first payment due upon issuance of the order. No provision for an interest calculation or payment.
