MAY 10, 2010
Minutes of a Regular Meeting of Council held on Monday, May 10, 2010 in Council Chambers City Hall commencing at 5:00 p.m.
Present: Mayor James Wilson, Councillors Arnelien, Fisher, Maloney, Okrainec, Pearen and Wyatt.
Staff Members present: David Putz, Bonnie Schenher, Lonnie Kaal, Michael Eger, Fran Brimacombe, and Don Kunkel. Recording: Gloria Signarowski.
A quorum being present Mayor James Wilson in the Chair called the meeting to order at 5:00 p.m.
APPROVAL OF AGENDA
Arnelien – Maloney
That the Regular Council Meeting Agenda and Committee of the Whole Council Meeting Agenda be approved as presented.
Councillor Okrainec had the opportunity to attend the Sports Hall of Fame Dinner. Special thanks to the committee who put that together. If you’ve never had the opportunity to attend this event it is worthwhile to go. Congratulations to the four members inducted, Terry Struthers for the media, Darryl Spelay for hockey, Rod Merritt for broomball and Alfredo Bermudas for soccer. Congratulations to all. It was a wonderful meal at the Gallagher Centre as this was the first event for our new caterer.
Councillor Maloney congratulated the Kalyna Dance Festival with 1,000 dancers from across Western Canada and the United States. Thank you to Adam Fetch and Curtis Maleschuk, their committee and all the volunteers. They are known across the Globe and because of their hard work we have attracted a lot of attention with the Rasalka Dance Group from the Ukraine coming here in October. We are proud to have them in our community. The Yorkton Short Film and Video Festival is coming up in May. There will be tons of events beginning on May 27th and culminating with the Golden Sheaf Awards on the 29th. It is a tremendous event to the City and I believe gains more notoriety for our City across Canada than any other event.
Mayor Wilson advised that next year is the 10th Anniversary for the Kalyna Dance Festival and this year is the 63rd Annual Yorkton Short Film and Video Festival.
Councillor Pearen advised that it was Riderville Week, an amazing week of activities with breakfasts, barbecues, decorating of store and office windows and volunteers working hundreds of hours to get this done. There was a parade on Saturday and a banquet in the evening. To Barry Sharpe, Roby Sharpe, Jason Farrell and all volunteers a job well done. He is hoping that Yorkton will be one of the contestants and he feels that Riderville is coming to Yorkton, “Where Good Things Happen”.

HEARING OF PETITIONS, PUBLIC NOTICES AND PRESENTATIONS
Proclamation – Tourism Yorkton – Tourism Awareness Week – June 6 – 12, 2010
A letter dated May 3, 2010 from Tourism Yorkton regarding a proclamation was circulated for the consideration of Council.
Mr. Neil Thom and Mrs. Randy Goulden were present in Council Chambers and Mr. Thom spoke to their request.

That Council authorize Mayor Wilson to proclaim the week of June 6 to 12, 2010 as “Tourism Awareness Week” in the City of Yorkton.
A symbolic cheque in the amount of $38.4 million was presented to Mayor Wilson for an estimate of the amount of tourism dollars spent in the City of Yorkton in a year.
Public Notice – Discretionary Use 03-10 – Heartland Livestock – 107 York Road East
There were no petitioners present in Council Chambers to speak for or against the Discretionary Use Application 03-10 from Heartland Livestock located at 107 York Road East.

Municipal Planning Commission Meeting Minutes – May 5, 2010

That the Municipal Planning Commission Meeting Minutes of May 5, 2010 be received and filed as presented.
Mayor – Appointment to the Yorkton Public Library Board

That the Council of the City of Yorkton appoint Ms. Margaret Phillips to replace Mr. Bob Ribchester on the Yorkton Public Library Board for the year 2010.
Mayor – Appointments to the Solid Waste Management Committee
That the Council of the City of Yorkton approve the attached 2010 appointments to the Solid Waste Management Committee.
INTRODUCTION OF BYLAWS
Bylaw No. 17/2010 – Amend Zoning Bylaw No. 14/2003 -Revise Boundaries for Previously Approved Contract Zone at 345 Morrison Drive [1st reading]
Pearen – Okrainec
That Bylaw No. 17/2010, an amendment to Zoning Bylaw No. 14/2003 which provides Contract Zoning for proposed Parcel N, NW & NE ¼ Sec. 1-26-4-W2nd, civically known as 345 Morrison Drive, be given 1st reading, and that Administration be authorized to proceed with the Public Notice process.
Manager of Engineering – 2010 Asphalt Program
A report dated April 29, 2010 from the Manager of Engineering regarding the 2010 Asphalt Program was circulated for the consideration of Council.
Arnelien – Maloney
That Administration be authorized to proceed with awarding the contract for the 2010 Asphalt Program to Fedorowich Construction Limited for the total bid price of $760,113.38 including G.S.T.
The Chair was passed to the Deputy at 5:11 and it reverted back at 5:12 p.m.
Manager of Engineering – Request for left turn lane to Airport
A report dated May 3, 2010 from the Manager of Engineering regarding a request for the Mayor to send a letter to the Department of Highways requesting a left turn lane into the Airport.
Okrainec – Fisher
That the Mayor send a letter to the Minister of Highways and Infrastructure requesting the construction of a left turning lane at the intersection of Highway 9 and the Airport Road.
Planner – Discretionary Use – 03-10 – Heartland Livestock – 107 York Road East
A report dated May 4, 2010 from the Planner regarding Discretionary Use Application 03-10 for 107 York Road East was circulated for the consideration of Council.
Wyatt – Fisher
That the proposed rear addition to a Livestock Sales Facility on Parcel D, Plan 72Y04422, civically know as 107 York Road East, be approved and that Administration be authorized to issue a Development Permit for the proposed use, subject to the requirements of Zoning Bylaw No. 14/2003.
Director of Finance – City of Yorkton Insurance
A report dated May 4, 2010 from the Director of Finance regarding the City of Yorkton’s Insurance was circulated for the consideration of Council.
Maloney – Arnelien
That Farrell Agencies Ltd. be awarded the contract to provide insurance brokerage and associated services for a period of seven (7) years from July 1st, 2010 to June 30th, 2017. That Farrell Agencies Ltd. assist Administration in setting up a Risk Management Program and further that they will on an annual basis provide details of competing carriers, rates and changes in coverage to the City Treasurer. Further, that Administration be directed to issue a request for proposals in April 2017 for insurance coverage on a 7 year contract.

That this resolution be tabled so that Council can review the information in more detail.

That we accept Recommendation No. 28-2010 as contained in the Committee of the Whole Council Meeting Minutes of May 10, 2010 that the 2010 Mill Rate Bylaws be prepared as indicated in the memorandum for all classes of property (as attached) and submitted for Council’s consideration on May 31st, 2010.
Director of Finance – Tax Arrears – Prost Enterprises Ltd. t/a Pastryworld

That we accept Recommendation No. C00030-2010 as contained in the Committee of the Whole Council Meeting Minutes of May 10, 2010 that Prost Enterprises Ltd., a business in the manufacturing/processing sector, be afforded a one-year tax abatement for 2010 in the amount of $8,053.03, provided existing taxes are paid in full.
City Manager – Yail Harbor Inc. Request for Land Donation
Pearen – Okrainec
That we accept Recommendation No. C00031-2010 as contained in the Committee of the Whole Council Meeting Minutes of May 10, 2010 that Yail Harbor’s request for a donation of land and servicing with total value ($65,400 + $94,800) $160,200 be approved and conditional upon Yail Harbor Inc. providing proof of financing for the remainder of the project being the construction of three tri-plexes to provide housing for the mentally and physically disabled in Yorkton. This offer to expire May 10, 2012.
