Minutes of a Regular Council Meeting held on Monday, June 28, 2010 in Council Chambers City Hall commencing at 5:00 p.m.

Present: Mayor James Wilson, Councillors Arnelien, Fisher, Maloney, Okrainec, Pearen and Wyatt

A quorum being present Mayor James Wilson in the Chair called the meeting to order at 5:00 p.m.

APPROVAL OF AGENDA

PUBLIC ACKNOWLEDGEMENTS

Councillor Bob Maloney advised that he had the pleasure of golfing in the Dollars for Scholars Golf Tournament in the City last Friday. He indicated that it was a good day and the Deer Park Municipal Golf Course is in tremendous condition considering all the rain we have had. All the money that was raised is for scholarships at the Parkland College. As well, every dollar that is raised by the golfers is matched by the Government as part of a matching agreement. It was a great day for the Parkland College and raising funds for scholarships for students that attend the College. It was very well run and a great afternoon.

HEARING OF PETITIONS, PUBLIC NOTICES AND PRESENTATIONS

Public Notice – Kent Flour Mill – Public Presentations

Ms. Sheila Harris, Ms. Carol Bolt and Ms. Pam Bush were present in Council Chambers to speak regarding the Public Notice for the demolition of all buildings located at 120 Livingstone Street, the (Kent Flour Mill) site, except for the mill. There were also two letters received with respect to this matter.

Public Notice – Bylaw No. 18/2010 – Borrowing Bylaw – Fire Hall

There were no petitioners present in Council Chambers to speak for or against the Public Notice for Bylaw No. 18/2010, a Borrowing Bylaw to provide for borrowing the sum of $7,300,000 for the purpose of financing the construction of the Fire Hall in the City of Yorkton.

Public Notice – Bylaw No. 26/2010 – Amend Municipal Development Plan Bylaw No. 15/2003 – Re-designating 7 Alderwood Place from IN to R-3

There were no petitioners present in Council Chambers to speak for or against the Public Notice for Bylaw No. 26/2010, a Bylaw of the City of Yorkton to amend Municipal Development Plan Bylaw No. 15/2003 which changes the Land Use Designation of Lot 33, Block 61, Plan 101444352, civically known as 7 Alderwood Place from Institutional to Residential.

Public Notice – Bylaw No. 27/2010 – Amend Zoning Bylaw No. 14/2003 – Increase Maximum Building Height in R-3 Zone

There were no petitioners present in Council Chambers to speak for or against the Public Notice for Bylaw No. 26/2010, an amendment to Zoning Bylaw No. 14/2003 which increases the maximum building height in the R-3 Medium Density Residential Zoning District from 12.6m or 3 stories to 16.8m or 4 stories.

Bylaw No. 18/2010 – Borrowing Bylaw – Fire Hall [2nd & 3rd Readings]

The Owners and Developer of the Property at 7 Alderwood Place arrived in Council Chambers at 5:32 p.m. and it was the consensus of Council to allow them to speak in favour of the project and the Public Notice for Bylaw No. 26/2010 and Bylaw No. 27/2010. Mr. Ken Wilson, Architect for the project, made the presentation.

A report dated June 16, 2010 from the Director of Planning and Engineering regarding the preparation of the statutory planning framework and bylaw implementation was circulated for the consideration of Council.

Director of Planning and Engineering – Subdivision Application – R.M. of Orkney No. 244 – RO469-10R

A report dated June 14, 2010 from the Director of Planning and Engineering regarding a subdivision application RO469-10R in the R.M. of Orkney No. 244 was circulated for the consideration of Council.

That Administration be directed to advise the Ministry of Municipal Affairs that Subdivision Application RO469-10R within the SE ¼ Sec. 12-25-5-W2 in the RM of Orkney No. 244 is outside of the Yorkton Planning District Boundary but that we support this development.

Director of Planning and Engineering – Review of King Street Traffic

A report dated June 21, 2010 from the Director of Planning and Engineering regarding the review of King Street traffic was circulated for the consideration of Council.

That Administration is directed to establish 4-way stop signs at the intersection of King Street and Laurier Avenue as well as King Street and Fifth Avenue in an attempt to reduce speeding along this roadway.

The Chair was passed to the Deputy Mayor Maloney at 5:58 p.m. and it reverted back at 5:59 p.m.

City Clerk – Kent Flour Mill

A report dated June 23, 2010 from the City Clerk regarding the Kent Flour Mill was circulated for the consideration of Council.

That Administration be authorized to proceed to tender for the demolition of all buildings located at 120 Livingstone Street, the (Kent Flour Mill) site, except for the mill. Further that Municipal Heritage Status is retained on this property and that the mill be secured so as to prevent unauthorized entry and protection from the elements.

That we accept Recommendation No. C00043-2010 as contained in the Committee of the Whole Council Meeting Minutes of June 28, 2010 that we expand the wording of condition 3 to include “college purposes”, provide an exclusive option to purchase that will expire June 30, 2014 if not exercised be approved and that a level one environmental assessment on the subject lands be provided and if required a level 2 environmental assessment be provided.

Plus a Standard Lease Agreement on the land for 3 years as per the City’s current Agricultural Land Rental rates.
