SEPTEMBER 13, 2010

Minutes of a Regular Meeting of Council held on Monday, September 13, 2010 in Council Chambers City Hall commencing at 5:00 p.m.

Present: Mayor James Wilson, Councillors Arnelien, Maloney, Okrainec, Pearen and Wilson.

Absent: Councillor Ross Fisher.

Staff Members Present: David Putz, Bonnie Schenher, Lonnie Kaal, Michael Eger, Dean Clark and Darcy McLeod. Recording: Gloria Signarowski.

A quorum being present Mayor James Wilson in the Chair called the meeting to order at 5:00 p.m.

APPROVAL OF AGENDA

PUBLIC ACKNOWLEDGEMENTS

Councillor Maloney advised that the Ducks Unlimited Tournament at Good Spirit Golf Course was held on Saturday, September 11, 2010 and it was a very blustery day. Councillor Wyatt and himself attended. It was a great fund raiser for Ducks Unlimited Wetlands.

Councillor Pearen commented on the successful Sunflower Weekend. There were many booths with over 4000 people attending that purchase goods and use hotel rooms, restaurants, etc. Congratulations to the organizers for a job well done. Councillor Pearen reminded us that the dwarf sunflower is the flower of the City.

Public Notice – Bylaw No. 33/2010 – Amend Municipal Development Plan Bylaw No. 15/2003 – Schedule B – Conceptual Land Use Map

There were no petitioners present in Council Chambers to speak for or against Bylaw No. 33/2010, a Bylaw to amend Municipal Development Plan Bylaw No. 15/2003 – Schedule B – Conceptual Land Use Map.

Public Notice – Bylaw No. 34/2010 – Amend Zoning Bylaw No. 14/2003 – Institutional District to Medium Density Residential District – 83 King Street East

Mr. Ron Skinner and Mr. Doug Rogers were present in Council Chambers to speak to the housing development proposed for this property. The proposed development are home ownership units with stand alone garages. The targeted price is under $200,000 GST included being 8 duplexes with 72 units in 9 buildings as well as a playground. They would be a modular design and take 4 months to build each unit. Construction of the first 16 units will take place after a presale of 8 units takes place.

Director of Finance – Tax Enforcement – 286 Maple Avenue and 173 Duncan Street West

A report dated September 1, 2010 from the Director of Finance regarding tax enforcement was circulated for the consideration of Council.

That tax enforcement proceedings be carried through to title acquisition on the properties known as 286 Maple Avenue and 173 Duncan Street West. Further, since both buildings have deteriorated and are in a dilapidated state, that an application to the Provincial Mediation Board include a reduction of the time required under The Tax Enforcement Act, for the City to take title.

Gladstone Avenue Traffic Flow Design Options

A report dated September 9, 2010 from the Director of Community Development, Parks and Recreation regarding the Gladstone Avenue Traffic Flow Design Options was circulated for the consideration of Council.

The Chair was passed to Deputy Mayor Wyatt at 5:29 p.m. and it reverted back at 5:31 p.m.

That Council approve that the second driving lane be put back in place between Broadway Street and Smith Street making the right hand lane into a shared use lane, and that appropriate signage be put in place.

That we accept Recommendation No. C00062-2010 as contained in the Committee of the Whole Council Meeting of September 13, 2010 that the offer for 287 and 299 Hamilton Road in the amount of $236,600 be accepted on the condition the purchaser will be responsible for the full cost for installation of sidewalks to be constructed to City standards.

Parkland College Land Donation [27.10(a)&(e)(i)(ii)(iii)(v)&(f)(iv)]

That we accept Recommendation No. C00063-2010 as contained in the Committee of the Whole Council Meeting of September 13, 2010 that the College’s request for:
1. A Phase II Environmental Assessment
2. An amendment to Section 7 re taxation
3. An amendment to Section 9 re legal fees be approved
And Further: That Clause 5(vi) be amended to permit the College to lease lands for Commercial purposes provided they enhance or compliment the College operations and functions.
