OCTOBER 18, 2010

Minutes of a Regular Meeting of Council held on Monday, October 18, 2010 in Council Chambers City Hall commencing at 5:00 p.m.

Present: Mayor James Wilson, Councillors Arnelien, Fisher, Maloney, Okrainec, Pearen and Wyatt.

Staff Members Present: David Putz, Bonnie Schenher, Lonnie Kaal, Gord Shaw, Michael Eger, Fran Brimacombe, Jeff Fawcett, Garvin Todosichuk and Darcy MacLeod (arrived @ 5:15 p.m.). Recording: Gloria Signarowski.

A quorum being present Mayor James Wilson in the Chair called the meeting to order at 5:00 p.m.

APPROVAL OF AGENDA

Proclamation – The Royal Canadian Legion – Veterans’ Week – November 3rd to 11th, 2010

A letter dated September 20, 2010 from the Royal Canadian Legion requesting a proclamation was circulated for the consideration of Council.
Mr. Peter Wyatt, President of the Royal Canadian Legion – General Alexander Branch #77 was present in Council Chambers to speak to their request.

Proclamation – Yorkton Chamber of Commerce/Yorkton Exhibition Association – Yorkton Agricultural Week – November 1st to 6th, 2010

An email received from the Executive Director of the Yorkton Chamber of Commerce regarding a proclamation was circulated for the consideration of Council.
Ms. Juanita Polegi, Executive Director of the Chamber of Commerce spoke to their request.

Presentation – Proposal to Install Temporary Speed Bumps on Milne Bay

A letter and accompanying signed petition dated October 13, 2010, was received from residents on Milne Bay regarding the installation of temporary speed bumps circulated for the consideration of Council.
Mr. Fred Schrader, a resident on Milne Bay, was present in Council Chambers to speak to their request.

Public Notice – Proposed Discretionary Use – 127 & 133 Good Spirit Crescent

Mr. Stephen Onda was present in Council Chambers to speak in favour of the proposed discretionary use at 127 and 133 Good Spirit Crescent to develop a three-plex on each of these lots.

A report dated October 1st, 2010 from the Director of Finance regarding an incentive agreement with LDM Yorkton Corp. for tax exemption was circulated for the consideration of Council.

That Administration be authorized to execute the incentive agreement with LDM Yorkton Corp. which provides a 5 year tax exemption (2009, 2010, 2011, 2012 and 2013) in conjunction with Section 263(5) of The Cities Act for purposes of economic development. Further that the 2008 taxes be written off, and that full taxes will be assessed and levied in 2014.

City Clerk – Appointment of a Property Maintenance Appeal Board

That the proposed Three-Unit Dwelling on Lot 62, Block 2, Plan 102 022 232, civically known as 133 Good Spirit Crescent, be approved and that Administration be authorized to issue a Development Permit for the proposed use, subject to the requirements of Zoning Bylaw No. 14/2003.

A report dated October 12, 2010 from the Manager of Engineering regarding RFP results for the Yorkton West Storm Drainage Study and Design was circulated for the consideration of Council.

That we accept Recommendation No. C00071-2010 as contained in the Committee of the Whole Council Meeting Minutes of October 18, 2010 that the purchase price for 69 Victoria Avenue (Lot 58, Block 22, Plan 99Y04947) remain at $20,300 and that the Phase I Environmental Assessment be completed in the name of the City of Yorkton and Trinity Electric Inc. with Trinity Electric Inc. being responsible for the full cost. If the Phase I Environmental Assessment is not “acceptable” then the City of Yorkton will reimburse Trinity Electric Inc. for the full cost of the Phase I Environmental Assessment.

Offer to Purchase - .89 Acres of 185 Gladstone Avenue North

That we accept Recommendation No. C00072-2020 as contained in the Committee of the Whole Council Meeting Minutes of October 18, 2010 that Administration be authorized to enter into an agreement for the sale of .89 acres of the C.J. Houston Property - 185 Gladstone Avenue N. (Lot 2, Block B, Plan 101858979) for a price of $104,000 which is the assessed value of the property including costs of surveying, subdivision and rezoning.
