REGULAR COUNCIL MEETING MINUTES
JUNE 13, 2011
Minutes of a Regular Meeting of Council held on Monday, June 13, 2011 in Council Chambers City Hall commencing at 5:00 p.m.
Present: Mayor James Wilson, Councillors Arnelien, Maloney, Okrainec, Pearen and Wyatt.
Absent: Councillor Fisher
Staff Members Present: David Putz, Bonnie Schenher, Lonnie Kaal, Gord Shaw, Michael Eger, Garvin Todosichuk, Jeffrey Fawcett and Brant Hryhorczuk. Recording: Gloria Signarowski.
A quorum being present Mayor James Wilson in the Chair called the meeting to order at 5:00 p.m.
Councillor Fisher arrived at 5:02 p.m.
APPROVAL OF AGENDA
Arnelien - Pearen
That the Regular Council Agenda and the Committee of the Whole Council Agenda be approved as presented.
Councillor Okrainec had the opportunity to go to the CPCA Pro Chuckwagon Classic this past Saturday. It was an awesome day. The CPCA Pro Tour event was held on Friday, Saturday and Sunday. Congratulations to the whole organization, it was a lot of fun, great steak and great racing. He encouraged everyone to attend an event like this when you have an opportunity. Also on Saturday he attended the 64th Field Battery Cadet Core Annual Ceremonial Review. It was great to see so many participants. Congratulations to Commanding Officer Captain Woytas and especially to Captain Evans who is a Reviewing Officer and is retiring after 42 years. This was his last inspection. Councillor Okrainec asked Mayor Wilson if he could comment on Decoration Day. Congratulations to the Legion and all the Veterans and everyone who was at Decoration Day on June 6th commemorating D-Day. He wanted to comment on an editorial in the paper that concerned him as it stated that the Councillors were conspicuous by their absence. He said that if Mr. Daniels wants to make those comments, maybe he should find out why they weren’t there. We weren’t there because we were at City Hall at a Property Standards Appeal Hearing and by the time the Hearing was over, we were unable to attend. Richard advised that he was not speaking for Council, but for himself. He is a Veteran. He served with NATO and the UN and he certainly didn’t need Mr. Daniels telling him why we have a free country. He knows why - he has been to a lot of places in the world through his service that are not free.
Mayor Wilson advised it was an honour to be part of Decoration Day and to march with the Veterans of our country with the realization of what we have. He appreciated Council staying back so he could attend.
Councillor Bob Maloney had the privilege to attend the Parkland College Graduation at St. Mary’s last Friday hosted by Councillor Pearen. He congratulated the 300 Graduates in the many programs offered by the College locally and on campuses around our area. Congratulations to the Graduates and their families. It was a special day. The hall was decorated very well, there were lots of happy people and he was very happy to be there. He reminded everyone of the Dollars for Scholars Golf Tournament coming up on Friday, June 17th. It is an opportunity to help out with scholarships for the Parkland College. The money raised goes directly to scholarships for local students taking courses at the College. He encouraged people to sign up for that if they can. It’s always a fun event and he will be hosting it.
Councillor Pearen advised that the Guest Speaker at the Graduation was a local girl Jennifer Richards who is also one of the Graduates. Jennifer is in the Tri-Trades program. She called herself a “grease-monkey” by day, which is a non-traditional trade for a female. Jennifer is competing for the Miss Teen Canada International Championship. She is one of eight representatives from Saskatchewan in Toronto in July. There is voting on line and he believes the website is www.missteencanadainternational.com. On Saturday he had the chance to represent the City at the Provincial Launch for “June is Parks and Recreation Month”. Although they had a small crowd, he thanked Darcy McLeod and Darren Spelay for a fine exhibition. We often take our parks for granted. He thanked Brian Dudar and his staff for the conditions of our parks. He realized we had a lot of rain to make it grow but we are very proud of our parks. When we have people visit from time to time, students or instructors either at the Gallagher Centre or the City Centre Park, they are amazed at the condition of our parks. We are proud of our facilities and it was a chance to celebrate that. He encouraged families and residents to get out and enjoy our green spaces.
Councillor Arnelien advised it was his privilege as Deputy Mayor to participate in the Grand Opening of a new business located on First Avenue in Yorkton, Ideal Weight Solutions. Good Luck to them.
Mayor Wilson thanked all of Council for participating in these events.
Councillor Fisher attended the Annual Charity Golf Classic Tournament for the Health Foundation. He thanked the weatherman for delivering a good day and thanked everyone who participated. There were 140 golfers, 45 volunteers, lots of sponsors and they raised well over $100,000 which will be invested back into our medical facility. He thanked everyone for participating in this event.
Mayor Wilson was honored to participate on June 1st at the official opening of the Cardinals by throwing the first pitch game ball. He joined our MLA in throwing the game ball for the Yorkton Cardinals. He asked everyone to get out and enjoy the entertainment, have a hot dog and drink and enjoy the 18 home game schedule. He thanked the volunteers for making the Cardinals a great organization and thanked the Coaches and the businesses sponsoring in the community.

HEARING OF PETITIONS, PUBLIC NOTICES AND PRESENTATIONS
Presentation - Request for Noise Bylaw No. 21/99 Exemption – June 24, 2011
An email received June 10, 2011 from the Canadian Cancer Society, Parkland Unit regarding a request for exemption under the Noise Bylaw was circulated for the consideration of Council.
Ms. Janet Sharpe, Manager of the Parkland Unit of the Canadian Cancer Society was present in Council Chambers to speak to their request.

That the request for an exemption under the Noise Bylaw No.21/99 for the “Relay for Life” event to be held on June 24th, 2011 be approved at the location they choose.
Presentation - Heart and Stroke Foundation – Heart Healthy Children and Youth Strategy
An email received May 11, 2011 from the Heart and Stroke Foundation of Saskatchewan along with pertinent background information were circulated for the consideration of Council.
Mr. Bill Ursel, Community Action Coordinator of the Heart and Stroke Foundation of Saskatchewan was present in Council Chambers to make a presentation.

That the presentation from the Heart and Stroke Foundation of Saskatchewan on the Heart Healthy Children and Youth Strategy be received and filed as presented.
Presentation - J.J. Smith Mill Committee – Provincial Heritage Status of Mill Site
A letter received in May of 2011 from the J.J. Smith Mill Committee along with pertinent background information was circulated for the consideration of Council.
Mrs. Sheila Harris, Chair of the Committee along with four other members of the J.J. Smith Mill Committee were present in Council Chambers and Mrs. Harris spoke to their request.

A letter dated June 1, 2011 from Ms. Kristin Boychuk regarding a request to paint a mural on the Riverside Terrace Bridge was circulated for the consideration of Council.

Bylaw No. 22/2011 – Amend Bylaw No. 15/2003 (2nd and 3rd reading) – Municipal Development Plan – Remove Phasing Designation of LSD 16, NE 36-25-04-W2nd

That Bylaw No. 22/2011, a Bylaw of the City of Yorkton to amend Municipal Development Plan Bylaw No. 15/2003 to remove the phasing designation of LSD 16, NE 36-25-04-W2nd from Schedule C – Future Residential, Commercial, Industrial and Parks and Recreation Phasing Map be read a third time this 13th day of June A.D. 2011 and registered in the Bylaw Register of the City of Yorkton.

A report dated June 13, 2011 from the Planner regarding a Discretionary Use application 01-11 at 83 Good Spirit Crescent for a semi-detached dwelling was circulated for the consideration of Council.

That the proposed Semi-Detached Dwelling on Lot 22, Block 1, Plan 00Y10405, civically known as 83 Good Spirit Crescent, be approved and that Administration be authorized to issue a Development/Building Permit for the proposed use, subject to the requirements of Zoning Bylaw No. 14/2003 and Building Bylaw No. 28/2002.
Director of Planning and Engineering – Kelsey Bay Extension Tender Results
A report dated June 13, 2011 from the Director of Planning and Engineering regarding Kelsey Bay Extension Tender Results was circulated for the consideration of Council.

That the contract for the Kelsey Bay extension construction be awarded to Fedorowich Construction Ltd., in the amount of $694,376.50 exclusive of GST and that Administration be authorized to prepare contract documents for execution by the Contractor and the City.
City Manager – Saskatchewan Municipal Board Boundary Change Process
A report dated June 9, 2011 from the City Manager regarding the Saskatchewan Municipal Board Boundary Change Process was circulated for the consideration of Council.

Director of Planning and Engineering - North Sanitary Sewer Trunk Main – Update

That we accept Recommendation No. C00030-2011 as contained in the Committee of the Whole Council Meeting Minutes of June 13, 2011 that the City engage the services of McDougall Gauley as legal counsel in the matter of the North Sanitary Trunk Main.
