AUGUST 22, 2011

Minutes of a Regular Meeting of Council held on Monday, August 22, 2011 in Council Chambers City Hall commencing at 5:00 p.m.

Present: Mayor James Wilson, Councillors Arnelien, Fisher, Maloney, Okrainec, Pearen and Wyatt.

Staff Members Present: David Putz, Bonnie Schenher, Lonnie Kaal, Gord Shaw, Nicole Chepil, Trent Mandzuk (arrived at 5:03 p.m.), Michael Eger, Jeff Fawcett and Garvin Todosichuk. Recording: Gloria Signarowski.

A quorum being present Mayor James Wilson in the Chair called the meeting to order at 5:00 p.m.

APPROVAL OF AGENDA

PUBLIC ACKNOWLEDGEMENTS

Councillor Fisher mentioned the Charity Road Race that was held yesterday. City Council entered a team. He thanked all those who participated. There were 252 registered. He advised that it takes a lot of work to put on an event of that size. There were over 40 volunteers. He thanked all the volunteers who made this event possible.

Mayor Wilson advised the Kinsmen will be sponsoring the Portraits of Honour, National Tour. The Portraits of Honour mural features the faces of the 156 men and women who have lost their lives in Afghanistan. It will take place tomorrow August 23, 2011 at 11:00 a.m. at the Western Financial Group City Centre Park. A barbecue will take place and he urged citizens to spend some time in honour of all those who have given their life for the freedom that we have in this country. Also tickets are still available for an Honour the Troops evening at the Gallagher Centre. As a community he urged people to take the time to acknowledge how fortunate we are and to recognize the brave men and women who gave up their lives for our country.

A report dated August 9, 2011 from the Director of Public Works regarding the Public Works Drainage Account was circulated for the consideration of Council.

That the additional expenditures of $200,000 related to the City’s drainage system in 2011 (primarily as a result of the Canada Day Flood in 2010) be offset by proceeds expected from the Provincial Disaster Assistance Program and/or unanticipated revenues from growth in the tax base.

Director of Finance - Tax Enforcement Proceedings – Six Month Notice

A report dated August 15, 2011 from the Director of Finance regarding Six Month Notice for Tax Enforcement Proceedings was circulated for the consideration of Council.

That authorization be granted under Section 22 of The Tax Enforcement Act to proceed with an application for “Six Month Notice” for title to the properties attached, but that Administration be authorized not to commence proceedings on any properties where a reasonable effort is being made to pay arrears of taxes.

Director of Finance - Tax Agreement – 41 York Road West

A report dated July 28, 2011 from the Director of Finance regarding a tax agreement on 41 York Road West (former Dairy Producers building) was circulated for the consideration of Council.

That Administration set up an agreement regarding tax arrears on 41 York Road West and that this property be included in the Enterprise Zone Incentive Program (vacant property tax abatement) on the condition that improvements to the property exceed $1,000,000.

Director of Planning and Engineering - Appointment of a Building Official

A report dated August 10, 2011 from the Director of Planning and Engineering regarding the appointment of a Building Official was circulated for the consideration of Council.

Director of Planning and Engineering - Brodie Storm Water Pond – Preliminary Design and Construction

A report dated August 15, 2011 from the Director of Planning and Engineering regarding the Brodie Storm Water Pond – Preliminary Design and Construction was circulated for the consideration of Council.

That Administration proceed to work with Associated Engineering in preparing the design and tendering of the Brodie Storm Water Pond project with construction scheduled for October of 2011; and that Administration be authorized to enter into a contract with Associated Engineering for the design and construction management of the Brodie Storm Water Pond in the amount of $84,500.00 exclusive of GST. Administration is further authorized to proceed with the work associated with the closure of Brodie Avenue.

Director of Planning and Engineering - Yorkton West Drainage – Next Stage – Preliminary Design Study

A report dated August 15, 2011from the Director of Planning and Engineering regarding the Yorkton West Drainage preliminary design study was circulated for the consideration of Council.

Director of Planning and Engineering - Tender Results for the York Colony Lands Project

A report dated August 2, 2011 from the Director of Planning and Engineering regarding the tender results for the York Colony Lands Project was circulated for the consideration of Council.

A report dated August 16, 2011 from the Director of Planning and Engineering regard entry level housing projects and the impact on the housing market was circulated for the consideration of Council.

That the Rental Housing Incentive Program (RHIP) be amended from its current format to include condominium development either as rental or home ownership; that Administration look at partnering with the adjacent developer on the C.J. Housing property to reduce construction costs on site servicing, and that Administration proceed to make applications to the Headstart on a Home Program for the C.J. Houston, the Good Spirit Crescent properties and the York Colony Lands Project.

Director of Planning and Engineering - Amendment to the Rental Housing Incentive Program (RHIP) Policy No. 10.250

A report dated August 15, 2011 from the Director of Planning and Engineering regarding an amendment to the Rental Housing Incentive Program (RHIP) was circulated for the consideration of Council.

That the Rental Housing Incentive Program (RHIP) is amended as follows: 2. Policy
1) B) The program will offer 5-year 100% tax exemption to the developers of a condominium project. The developer must establish a condominium association or board for each project that will be responsible for administration of the exemption and reporting to the City. The exemption will require the condominium association or board to enter into an agreement that can be registered against the entire project. If any of the units are sold prior to the completion of the 10 year agreement the condominium association or board will be required to repay the taxes for each unit sold on the following basis; and,
Section 2)B) The program will offer 2-year 100% tax exemption to the developers of a condominium project. The developer must establish a condominium association or board for each project that will be responsible for administration of the exemption and reporting to the City. The exemption will require the condominium association or board to enter into an agreement that can be registered against the entire project. A report dated August 18, 2011 from the Director of Planning and Engineering regarding the Headstart on a Home Program (HSHP) Policy No. 10.290 was circulated for the consideration of Council.

That the Headstart on a Home Policy No. 10.290 to provide $5,000.00/door to qualified homebuyers for new entry level single-family homes created through the Headstart on a Home program to be repaid from taxes on an annual basis and secured by a second mortgage on the property be adopted.

Planner – Discretionary Use – DU02-11 – PUD – 164 Fifth Avenue South

A report dated August 15, 2011 from the Planner regarding a discretionary use at 164 Fifth Avenue South was circulated for the consideration of Council.
