Minutes of a Regular Meeting of Council held on Monday, September 12, 2011 in Council Chambers City Hall commencing at 5:00 p.m.

Present: Mayor James Wilson, Councillors Arnelien, Maloney, Okrainec and Wyatt.

Absent: Councillors Ross Fisher and Larry Pearen.

Staff Members Present: David Putz, Bonnie Schenher, Lonnie Kaal, Michael Eger, Jeff Fawcett and Brant Hryhorczuk. Recording: Gloria Signarowski.

A quorum being present Mayor James Wilson in the Chair called the meeting to order at 5:00 p.m.

Proclamation – September as “Big Brothers/Big Sisters Month”

A letter dated August 31, 2011 along with a proclamation from Big Brothers and Big Sisters of Yorkton and area were circulated for the consideration of Council. Ms. Twila Seeley was present in Council Chambers to speak to their request.

Public Notice – Bylaw No. 10/2011- Amend Zoning Bylaw No. 14/2003 – Allow for a Dwelling Manufacturing Facility (off-site) as a Discretionary Use in the C-1, C-2 and C-3 Zoning Districts.

There was no one present in Council Chambers to speak for or against Bylaw No. 10/2011 to amend Zoning Bylaw No. 14/2003 to allow for a Dwelling Manufacturing Facility (off-site) as a Discretionary Use in the C-1, C-2 and C-3 Zoning Districts.

Public Notice – Proposed Discretionary Use Application at 164 Fifth Avenue South

Mr. Doug Rogers and Mr. Ron Skinner were present in Council Chambers for this item and Mr. Rogers spoke in favour of the Proposed Discretionary Use Application for 164 Fifth Avenue South.

Public Notice – Proposed Discretionary Use Application – 66 and 70 Seventh Avenue South

Mr. Brett Jones from 65 Sixth Avenue North was present in Council Chambers and spoke against the proposed Discretionary Use Application for 66 and 70 Seventh Avenue North.
Mr. Bruce Holm was present in Council Chambers to speak in favour of the Proposed Discretionary Use Application for 66 and 70 Seventh Avenue North.

ADMINISTRATIVE REPORTS

Director of Finance – SUMA Resolution – Amend Appeal Period for Supplemental Assessments

A report dated September 7, 2011 from the Director of Finance regarding a SUMA Resolution to amend Appeal Period for Supplemental Assessments was circulated for the consideration of Council.

That the City of Yorkton put forth the following resolution to the 2012 Saskatchewan Urban Municipalities Association Convention to amend The Cities Act to address this issue.

WHEREAS, Section 185(1.1) of The Cities Act, requires that in the year of revaluation, the assessment notice or amended assessment notice must have not less than 60 days to appeal the assessment;

AND WHEREAS, Section 189(1) allows for a supplementary assessment to be made if a property's value changes during the year;

AND WHEREAS, Section 189(2.1) requires that the same rules apply to the Supplementary Assessment process as to that set out in Section 185 of The Cities Act;

AND WHEREAS, all properties may appeal their annual assessment notice or amended assessment notice, however only those properties affected by a Supplemental Assessment Notice can appeal their Supplemental Assessment Notice;

AND WHEREAS, Supplemental Notices are not processed typically until October or November of the year, thus the 60 day appeal period causes great delays in the completion of the work process of the Assessment;

THEREFORE BE IT RESOLVED, that Section 185 (1.1) The Cities Act be amended to allow a 30 day appeal period for Supplemental Assessments in revaluation years.

Director of Planning and Engineering - North Sanitary Trunk Main

A report dated September 6, 2011 from the Director of Planning and Engineering regarding the North Sanitary Trunk Main to construct additional manholes on this trunk main was circulated for the consideration of Council.

That we accept Recommendation No. C00043-2011 as contained in the Committee of the Whole Council Meeting Minutes of September 12, 2011 that the property known as Lot 16, Block C, Plan No. CE6408, the .10 acres adjacent to the west of Lots 1 & 2, Block 4, Plan AA1366, known civically as 80 King Street West be sold to Terry and Janet Pollock for the appraised value of $9,625.00 on the condition that all three lots are consolidated into one at the expense of the Purchaser.
