Minutes of a Regular Council Meeting held on Monday, October 17, 2011 in Council Chambers City Hall commencing at 5:00 p.m.

Present: Mayor James Wilson, Councillors Arnelien, Fisher, Maloney, Okrainec, Pearen and Wyatt.

Staff Members Present: David Putz, Bonnie Schenher, Gord Shaw, Michael Buchholzer, Michael Eger, Nicole Chepil, Brant Hryhorczuk and Joshua Mickleborough. Recording: Gloria Signarowski.

A quorum being present Mayor James Wilson in the Chair called the meeting to order at 5:00 p.m.

APPROVAL OF AGENDA

A letter dated September 27, 2011 from the Executive Director of the Yorkton Chamber of Commerce and the Manager of the Yorkton Exhibition Association was circulated for the consideration of Council.
Ms. Juanita Polegi, Executive Director of the Yorkton Chamber of Commerce was present in Council Chambers to speak to their request.

A letter dated September 23, 2011 from the Royal Canadian Legion regarding a proclamation was circulated for the consideration of Council.
Comrade Harold Petkau, Third Vice-President and Comrade Bob Lee were present in Council Chambers. Comrade Petkau spoke to their request.

A report dated October 7, 2011 from the Planner regarding the naming of a street was circulated for the consideration of Council.

Director of Environmental Services - Queen Street WTP – Contract 10: Water Supply Main

A report dated October 7, 2011 from the Director of Environmental Services regarding Queen Street WTP, Contract 10: Water Supply Main was circulated for the consideration of Council.

That G. Unger Construction Company Ltd. be awarded the Queen Street Water Treatment Plant, Contract 10: Water Supply Main for a contract price of $470,250.00. Further, that the construction budget includes a contingency allowance of $79,750.00 for a total construction budget of $550,000.00.

Director of Environmental Services - Agreements with Out-of-City Customers at Sanitary Landfill

A report dated October 4, 2011 from the Director of Environmental Services regarding agreements with Out-of-City Customers at the Sanitary Landfill was circulated for the consideration of Council.

That Administration be authorized to renew or enter into agreements with Out-Of-City Customers including Villages, Rural Municipalities and Businesses that pick up out of city refuse and haul to the City of Yorkton Sanitary Landfill for the balance of 2011, 2012 and 2013, with an option that these agreements can be renewed for an additional two years with the consent of both parties.

Director of Planning and Engineering - Yorkton Transportation Master Plan

A report dated October 3, 2011 from the Director of Planning and Engineering regarding the Yorkton Transportation Master Plan was circulated for the consideration of Council.

Director of Planning and Engineering - Brodie Storm Water Pond – Tender Results

A report dated October 3, 2011 from the Director of Planning and Engineering regarding the Brodie Storm Water Pond Tender results was circulated for the consideration of Council.

That Curtis Construction Ltd. be awarded the Brodie Avenue Storm Water Detention Pond Tender in the amount of $311,800.00 exclusive of GST. Further, that the construction budget includes an engineering and contingency allowance of $266,630.00 for the construction component and a total project budget of $2,228,430.00.

Director of Planning and Engineering - Drainage Affected by Installation of Culvert in R.M. of Orkney

A report dated October 5, 2011 from the Director of Planning and Engineering regarding drainage affected by installation of a culvert in the R.M. of Orkney was circulated for the consideration of Council.

1. That the following resolution be approved by City Council:
a. “The City of Yorkton has viewed General Plan Drainage Report E5-1358-01 for the construction of drainage works south of Section 26-25-04-W2nd and how it may affect the City of Yorkton’s municipal road right-of-way (service road) in the NW 25-25-04-2, a copy of which is attached.
b. The City of Yorkton provides its sanction to allow the Rural Municipality of Orkney, No. 244, to construct drainage works south of the southern boundary of Section 26-Township 25-Range 4, West of the Second Meridian to alleviate the yard site flooding problems being encountered on Blk/Par D-Plan 101804655 Ext. 31 (portion SE 27-25-04-2-Ext. 31) Douglas Arnold Poier and Loreen Eleanor Poier) and Blk. Par A – Plan 77YO5080 Ext (portion NE 22-25-4-2) (Delores Roebuck and Joseph Roebuck) as more particularly shown in General Plan Drainage Report E5-1358-01.” Further, that Administration corresponds with the Rural Municipality on this resolution.
Councillor Wyatt opposed.

Director of Planning and Engineering - Commercial Subdivision Adjacent to Tourism Centre – Tender Results

A report dated October 5, 2011 from the Director of Planning and Engineering regarding tender results for a commercial subdivision adjacent to the Tourism Centre was circulated for the consideration of Council.

That G. Ungar Construction Ltd. be awarded the commercial subdivision development contract for the amount of $3,228,603.70. Further, that an engineering and contingency component [$387,432.00 + $645,720.00 = $1,033,152.00] be added for a total cost of this component being $4,261,756.00.

The Chair was passed to Deputy Mayor Larry Pearen at 5:33 p.m. and it reverted back at 5:34 p.m.

Director of Planning and Engineering - Collacott Drainage Review

A report dated October 3, 2011 from the Director of Planning and Engineering regarding the Collacott Drainage Review was circulated for the consideration of Council.

That Option Two, being an option to re-shape the ditch and add swales to intercept storm water within the park behind Collacott Drive, be selected to address the storm water drainage issue with Public Works Staff being used, where possible, to implement this option. Further, if Public Works Staff are not available, then Administration would proceed to hire a contractor to make the improvements up to a maximum of $25,000.00.

Director of Planning and Engineering - Change in Speed Zones on Highway No. 9

A report dated October 17, 2011 from the Director of Planning and Engineering regarding change in speed zones on Highway No. 9 North was circulated for the consideration of Council.

That speed zone change on Highway No. 9 from Grain Millers Road to Highway No. 16 as shown on the attachment to this report be implemented in a phased manner that includes advertising and notification to the public, more specially, from south of Grain Millers Road to approximately 600 m north of York Road, a 70 km zone with a transition to 60 km at this distance to York Road. The speed limit south of the York Road intersection of Highway No. 16 will be 50 km.

That we accept Recommendation No. C00051-2011 as contained in the Committee of the Whole Council Meeting Minutes of October 17, 2011 that the offer of $60,000.00 to purchase the parcel of land located on Northern Boundary of Lot 8, Block 4, Plan 90Y02063 (464 Broadway Street East) with a down payment of $12,000.00 and four annual payments of $12,000.00 starting in October 2012 be accepted on condition that interest be charged on the outstanding balance at a rate of 3% per annum and all legal fees be paid by the City; and further that title to the property will remain in the City’s name until paid in full and at the time the purchaser receives title, the purchaser will consolidate the title for both properties.

Sale of Land for Grain Millers Road Widening and Upgrading

That we accept Recommendation No. C00052-2011 as contained in the Committee of the Whole Council Meeting Minutes of October 17, 2011 that the request of the R.M. of Orkney No. 244 to purchase, approximately 7 meters of land extending 1 km west of Highway No. 9 adjacent to the existing Grain Millers Road right-of-way in order to accommodate the road widening and upgrading be approved for consideration of one dollar ($1.00).
Councillor Chris Wyatt opposed.

Out-of-Scope 2012 Salary Increase [27.10(e)(iii)&(f)(iv)&(v)]

That we accept Recommendation No. C00054-2011 as contained in the Committee of the Whole Council Meeting Minutes of October 17, 2011 that Administration be authorized to implement a 2% cost of living adjustment for Out-of-Scope employees effective January 1, 2012, with a review of the CUPE Local 342 negotiated settlement to determine whether a future adjustment to the Out-of-Scope cost of living adjustment is required.
