Minutes of a Regular Council Meeting held on Monday, May 28, 2012 in Council Chambers City Hall commencing at 5:00 p.m.

Present: Mayor Wilson, Councillors Arnelien, Fisher, Maloney, Okrainec, Pearen and Wyatt.

Staff Members Present: Bonnie Schenher, Gord Shaw, Darcy McLeod, Michael Eger, Brant Hryhorczuk, Chris Wentzell, Don Kunkel, Josh Mickleborough, Lisa Washington and Trent Mandzuk

A quorum being present Mayor Wilson in the chair called the meeting to order at 5:00 p.m.

APPROVAL OF AGENDA

PUBLIC ACKNOWLEDGEMENTS

Councillor Richard Okrainec acknowledged the 80 graduates of the Sacred Heart Graduating class of 2012. Councillor Okrainec brought greetings on behalf of the City. This year would have been the year Brayden Ottenbreit would have graduated.

This is the 15th year for The Brayden Ottenbreit Close Cuts for Cancer. Over $40,000 was raised for research and over $12,000 for local cancer initiatives. In the 15 years this event has taken place $625,000.00 has been raised for cancer research.

Mayor James Wilson welcomed Teresa Miller to the City. She assumed the role of Executive Assistant to the Mayor and City Manager.

This year was the 65th Annual Yorkton Film Festival – Congratulations to Randy Goulden, the Executive Director for a great festival and thanks to all the volunteers and Board members who participated.

Two Council Members received a Jamie Award. This award is for a community recognition program started in honour of the festival’s 65th anniversary. In the category “Community” for his involvement in the community – Bob Maloney and in the category “Education and Learning” – Larry Pearen. Congratulations to both for these well-deserved awards.

A memo dated May 18, 2012 from Sheila Hryniuk, Chairperson of the Yorkton Active Transportation Collaborative regarding a proclamation was circulated for the consideration of Council. Sheila Hryniuk was present in Council Chambers to speak to this request.

A memo dated May 16, 2012 from Mayor Wilson regarding the appointment of a representative from the City of Yorkton to the Community Futures Ventures Board was presented for Council’s consideration.

A report dated May 22, 2012 from the Planner regarding the revised Discretionary Use application for a Planned Unit Development, consisting of two, twelve-unit Apartment dwellings at 138 and 148 Catherine Street (north portion of former C.J. Houston site) was circulated for the consideration of Council. Michael Eger was present in Council Chambers to speak to this report.

A report dated May 23, 2012 from the Communications Manager regarding a brand identity for the City of Yorkton was circulated for the consideration of Council. Darcy McLeod was present in Council Chambers to speak to this report.

York Lake Regional Park Authority – York Lake Road Contract Proposal [27.10(a)(e)(i)(iii)(v)]

That we accept Recommendation No. C00030-2012 as contained in the Committee of the Whole Council Meeting Minutes of May 28, 2012 that Administration is directed to write a letter to the York Lake Regional Park Authority to advise them that the City is not prepared to participate in this proposal as the City follows engineered design standards and a public tendering process.

Director of Planning and Engineering – Lot Pricing for CJ Houston Land Project [27.10(e)(i)(iii)(iv)(v)]

That we accept Recommendation No. C00031-2012 as contained in the Committee of the Whole Council Meeting Minutes of April 30, 2012 that Administration be authorized to establish the lot pricing for the CJ Houston land project as shown in Attachment 2 to this report. Further, if cost savings can be achieved through this project these will be passed on when calculating lot prices.
Councillor Maloney opposed.

Director of Human Resources - Ratification of CUPE Local 342 2012 – 2015 Contract [(27.10(e)(ii)(iii)(iv)(v)]

A report dated May 28, 2012 from the Director of Human Resources contract with CUPE Local No. 342 was circulated for the consideration of Council. Chris Wentzell was present in Council Chambers to speak to this report.

That we accept Recommendation No. C00032-2012 as contained in the Committee of the Whole Council Meeting Minutes of May 28, 2012 that Administration be authorized to ratify the agreement between the City of Yorkton and CUPE Local No. 342, for a four year contract from 2012 – 2015 with a compensation package of 3% for 2012, 3% for 2013, 3.5% for 2014 and 3.5% including a COLA clause for 2015.

City Manager - 495 Broadway Street West [(27.10(e)(iii)& (f)(iv)& (v)]]

A report dated May 24, 2012 from the City Manager was circulated for the consideration of Council. Darcy McLeod was present in Council Chambers to speak to this report.

That we accept Recommendation C00034-2012 as contained in the Committee of the Whole Council Meeting Minutes of May 28, 2012 that the agreement with SLC Acquisition Corp. be amended as follows:
a. The deposit is reduced to $5,000 from the current $50,000.
b. SLC can have eighteen months from June 1, 2012 (November 1, 2014) to remove the conditions.
c. Deposit increased to $100,000 on removal of conditions (presently increases from $50,000 to 150,000).
d. Closing is 60 days after removal of conditions as per present agreement.
e. SLC is authorized to place a sign on the property for marketing purposes.
f. Should the City receive another bona fide offer on the property SLC will have 90 days to complete the purchase.
Councillor Fisher and Wyatt opposed.
Carried.***
