August 20, 2012

Minutes of a Regular Council Meeting held on Monday, August 20, 2012 in Council Chambers City Hall commencing at 5:00 p.m.

Staff Members Present: Bonnie Schenher, David Putz, Lonnie Kaal, Gord Shaw, Michael Eger, Josh Mickleborough, Trent Mandzuk, Brant Hryhorczuk, Chris Wentzell and Kelly Kaban

A quorum being present Mayor James Wilson in the chair called the meeting to order at 5:00 p.m.

APPROVAL OF AGENDA

Councillor Fisher arrived at 5:01 p.m.

PUBLIC ACKNOWLEDGEMENTS

Councillor Maloney wanted to remind everyone that Sunflower, an annual craft show will be held September 7 – 8, 2012 at the Gallagher Centre and he encouraged everyone to attend. He also congratulated the Yorkton Arts Council for the very successful event they put on every year.

Councillor Okrainec noted that he attended the Yorkton Exhibition Annual Tractor Pulls, and it was very enjoyable. The attendance was very good with approximately 2000 people each day from all over Saskatchewan, Alberta and Manitoba. Last week he gave a tour of City Hall to a group from Big Brothers Big Sisters, and the response from the group of youth that attended was very positive. He also publicly thanked Big Brothers Big Sisters for the work they do in the community.

Councillor Pearen noted that he attended a tour of RAM Industries on Wednesday prior. He was very impressed with the facility’s expansion and how bright and clean the facility is. Thank you to the Malinowski family, a big part of Yorkton past and present.

Director of Planning and Engineering – Sanitary Service to Quance Development Lands

A report dated August 13, 2012 from the Director of Planning & Engineering regarding Sanitary Service to Quance Development Lands was circulated for consideration of Council. Gord Shaw was present in Council Chambers to speak to this report.

That Administration be authorized to proceed with detailed engineering on a gravity sanitary trunk main between Husky Road and Lilly Avenue and to provide Council with a detailed construction budget when this work is completed.
That Administration be authorized to proceed with the detailed engineering on a gravity sanitary trunk main east of Lilly Avenue to the eastern city boundary if the Quance Development Group commits to cost sharing this work with the city.
Further, Administration be authorized to enter into a cost sharing agreement with the Quance Development Group for this engineering work if there is a commitment.
That Administration be authorized to proceed with the preliminary engineering on the sanitary trunk main on Husky Road between Broadway Street E to the WWTP to determine the scope of work and a detailed construction cost estimate.
This work is to be brought back to City Council for more discussion when it is completed.

Manager of Engineering – Broadway to King Recreation Corridor

A report dated August 16, 2012 from the Manager of Engineering regarding the Broadway to King Recreation Corridor was circulated for the consideration of Council. Josh Mickleborough was present in Council Chambers to speak to this report.

That Administration be approved to proceed with using the Standing Offer Agreement for the construction management of the Broadway to King Street recreation corridor project. With a report back to council should unforeseen scope changes be encountered or at project completion.

Director of Public Works – Tender Results for 2012 Myrtle Avenue Reconstruction

A report dated August 13, 2012 from the Director of Public Works regarding the Myrtle Avenue Reconstruction was circulated for the consideration of Council. Trent Mandzuk was present in Council Chambers to speak to this report.

That Federowich Construction be awarded the contract to reconstruct Myrtle Avenue for the tender price of $629,543.30 (+ $50,000 contingency) using $159,543.30 from the Public Works Operational budget to fund the balance required in addition to approved capital funding.

That we accept Recommendation No. C00054-2012 as contained in the Committee of the Whole Council Meeting Minutes of August 20, 2012 that the Mayor and City Clerk be authorized to sign an agreement with Corey Holdings provided it contain the following conditions:
a) Purchase of Parcel K, L and M $774,000 to be paid in full prior to commencement of construction.
b) A performance bond or irrevocable letter of credit for 50% of the cost be provided for each phase to ensure completion should the proponent fail to do so.
c) That the condominium building be articulated in greater detail to lessen the intrusion on single family homes across the street.
d) That appropriate accesses be provided for Fire Trucks at all times.
e) That the property be taxed at the regular taxation rates as set by the City of Yorkton.
Mayor Wilson opposed.

Administration be authorized to enter into a 5 year renewable Encroachment Agreement with the owner of 230 Broadway Street East for a mutually agreeable portion of adjacent Highway 9 and Broadway Street East Rights-of-Way, and further that the Agreement require the owner compensate the City at market-value lease rates.
