Minutes of a Regular Council Meeting held on Monday, January 14, 2013 in Council Chambers City Hall commencing at 5:00 p.m.

Present: Mayor Maloney, Councillors Arnelien, Fisher, Goulden, Wilson and Wyatt

Absent: Councillor Pearen

A quorum being present Mayor Maloney in the chair called the meeting to order at 5:00 p.m.

Bylaw No. 1/2013 – Closure of Potoski Street [First Reading]

Bylaw No. 2/2013 – Amendment to the Municipal Development Plan Bylaw No. 15/2003 – Land Use Designation for York Colony Subdivision [First Reading]

That Bylaw No. 2/2013, an amendment to the Municipal Development Plan Bylaw No. 15/2003 which affects the York Colony Subdivision, being part of SW ¼ Sec. 12-26-4-W2, by changing the Residential and Commercial Land Use Designation boundaries (Schedule B) and removing the Future Phasing Designation (Schedule C), be given first reading, and that Administration be authorized to proceed with the Public Notice process.

Bylaw No. 3/2013 – Amendment to Zoning Bylaw No. 14/2003 – Zoning Districts for York colony Subdivision [First Reading]

Director of Community Development, Parks and Recreation – 2013 Pest Control Officer, Weed Inspector and Municipal Inspector Appointments

A report dated December 20, 2012 from the Director of Community Development, Parks & Recreation regarding the 2013 Pest Control Officer, Weed Inspector and Municipal Inspector appointments was circulated for the consideration of Council. Darcy McLeod was present in Council Chambers to speak to this report.

Fire Chief – Changes to The Alcohol Control Regulations, 2002

A report dated January 9, 2013 from the Fire Chief regarding changes to The Alcohol Control Regulations 2002, was circulated for the consideration of Council. Dean Clark was present in Council Chambers to speak to this report. It was requested that a letter be sent to the SLGA outlining Council’s position.

That the hours of operation established by the Province, during which alcohol may be legally sold remain the same as is currently legislated and that the Province continues to maintain and control the hours of operation for alcohol sales.

Director of Planning and Engineering – Yorkton West Drainage – Preliminary Design Stage Update

A report dated January 2, 2013 from the Director of Planning and Engineering regarding Yorkton West Drainage – Preliminary Design Stage Update was circulated for the consideration of Council. Gord Shaw was present in Council Chambers to speak to this report.

That Engineering Services is authorized to proceed with a review of installing an improved pipe network across Broadway Street to the Victoria Avenue ditch and improvements to this ditch to York Road in isolation of upstream improvements.
Furthermore, Engineering Services is authorized to proceed with a review of a different alignment to divert storm water from the Silver Heights subdivision and the hospital to Logan Green.
Councillor Wyatt opposed.

Director of Planning and Engineering – Change in Speed Zones on Highway 9

A report dated January 2, 2013 from the Director of Planning and Engineering regarding the change in Speed Zones on Highway 9 was circulated for the consideration of Council. Gord Shaw was present in Council Chambers to speak to this report.

The speed zones on Highway 9 from Grain Millers Drive to Queen Street as shown Attachment 2 of this report are implemented by Engineering Services and Public Works. More specifically, the following speed zones apply:
a. Northbound from the first entrance to the Humpty’s Restaurant to the entrance to the Tourism Centre, the speed limit will be 70 km;
b. Northbound from the Tourism Centre entrance to north of the main entrance/egress point from Parkland Mall/York Station the speed limit will be 60 km;
c. Northbound from the main entrance/egress point from Parkland Mall/York Station to the entrance/egress point to the service road on the east side of the roadway the speed limit will be 70 km; and,
d. Northbound from the entrance/egress point to the service road to the intersection with Grain Millers Drive, the speed limit will be 80 km.
e. Southbound from Grain Millers Drive to the entrance/egress point of the service, the speed limit will be 80 km;
f. Southbound from the entrance/egress point of the service road to approximately 30 m north of the main entrance/egress to Parkland Mall/York Station, the speed limit will be 70 km;
g. Southbound from the main entrance/egress to Parkland Mall/York Station to the Tourism Centre entrance, the speed limit will be 60 km;
h. Southbound from the entrance to the Tourism Centre to the second entrance to the Humpty’s Restaurant, the speed limit will be 70 km; and,
i. Southbound from this point the speed limit will be 80 km/h before increasing to 100 km/h.
Furthermore, this change in speed zones be advertised by Engineering Services before the change occurs to alert residents.
Councillor Goulden opposed.

City Manager – Yorkton Brick Mill Heritage Society – Request to Issue Tax Receipt

A report dated January 9, 2013 from the Yorkton Brick Mill Heritage Society regarding a request to issue tax receipts was circulated for the consideration of Council. David Putz was present in Council Chambers to speak to this report.

That we accept Recommendation No. C00002-2013 as per the Committee of the Whole Council Meeting Minutes of January 14, 2013 that subject to the outcome of a meeting with landowners, Engineering Services is authorized to proceed with obtaining an engineering proposal from Associated Engineering for the detailed engineering of a sanitary trunk main from Broadway Street East to the Wastewater Treatment Plant.
Furthermore, Engineering Services will report to City Council on the outcome of the meeting with the landowners and the engineering proposal in the first quarter of 2013.
