REGULAR COUNCIL MEETING MINUTES
May 11, 2015

Minutes of the Regular Council Meeting held on Monday, May 11, 2015 in City Hall Council Chambers.

Present: : Mayor Bob Maloney, Councillors Les Arnelien, Ross Fisher, Randy Goulden, Larry Pearen and James Wilson

A quorum being present Mayor Bob Maloney in the chair called the meeting to order at 5:00 p.m.

APPROVAL OF AGENDA

PUBLIC ACKNOWLEDGEMENTS

Councillor Goulden acknowledged a local Yorkton group, the Paper Bag Players, who attended TheatreFest in Melfort at the end of April. They showcased a play they had done for the dinner theatre in Yorkton at Christmas and they were the winners of two awards, Best Actress and Winning Play.

Mayor Maloney acknowledged the Bike Safety Week Rodeo held last week. He thanked the Yorkton RCMP, the Yorkton Fire Services and the schools for participating in the rodeo. The kids received bike helmets and some great instruction on bike safety, and some of the Fire Services members were in attendance to fix bikes for the young people. He congratulated the groups at Canadian Tire on Saturday where they gave away four bikes to the winners of draws and those who had won the coloring contest.

Councillor Goulden declared a conflict of interest in the next agenda item to be discussed and vacated the Council Chambers – 5:02 p.m.

HEARING OF PETITIONS, PUBLIC NOTICES AND PRESENTATIONS

Proclamation Request – Tourism Yorkton – “Tourism Week” – May 31-June 6, 2015

A letter dated May 5, 2015 from Tourism Yorkton regarding the proclamation of Tourism Week from May 31-June 6, 2015 was circulated for the consideration of Council. Neil Thom - President was present in Council Chambers to speak to this request and presented a 38.1 million dollar cheque representing dollars spent directly in the Yorkton constituency.

Mayor Maloney passed the chair to Deputy Mayor Wilson – 5:05 p.m.
The chair reverted back to Mayor Maloney – 5:06 p.m.

Councillor Goulden was invited back into the Council Chambers as the matter she had declared a conflict of interest in had been dealt with – 5:07 p.m.

Presentation – Habitat for Humanity - Update

A letter received May 7, 2015 from Habitat for Humanity regarding an update from the organization was circulated for the consideration of Council. Tom Seeley was present in Council Chambers to speak to this item.

Public Notice – Proposed Discretionary Use DU01-2015 – 304 Myrtle Avenue

Tom Seeley - representative of the Yorkton Habitat for Humanity was present in Council Chambers to speak for, and no petitioners were present to speak against, proposed Discretionary Use Application DU01-2015 for a semi detached dwelling at 304 Myrtle Avenue.

Public Notice – Proposed Discretionary Use DU02-2015 – Maple Farm Equipment

There were no petitioners present in Council Chambers to speak for or against, proposed Discretionary Use Application DU02-2015 for an agricultural sales and service establishment – Maple Farm Equipment.

Planner - Discretionary Use 02-2015 – Agricultural Sales and Service Establishment in C-3 Zone – Maple Farm Equipment

A report dated May 6, 2015 regarding Discretionary Use Application DU02-2015 for an agricultural sales and service establishment – Maple Farm Equipment, was circulated for the consideration of Council. Michael Eger - Planner was present in Council Chambers to speak to this report.

That Discretionary Use application DU02-2015, which proposes an Agricultural Sales and Service Establishment at 510 York Road West, legally described as Parcel B, Plan 101440448, be approved, and that the Development Officer be authorized to issue a Development Permit on the following conditions:
a. That the setback of the cold storage shed be increased from 4.5 metres to 9.0 metres; and
b. That the private driveway be hard-surfaced (concrete or asphalt), at the sole cost of the applicant/owner.

Director of Public Works – Highway #10 Reconstruction

A report dated May 5, 2015 from the Director of Public Works regarding Highway #10 Reconstruction was circulated for the consideration of Council. Trent Mandzuk - Director of Public Works was present in Council Chambers to speak to this report.

That the reconstruction tender for the Highway #10 and Mayhew Avenue project be awarded to Acadia Paving Ltd. for a total tendered price of $2,270,475.75 (excluding G.S.T.); and furthermore that it be acknowledged that funding for the Highway #10 project is in accordance with the City’s 2015 Capital Budget, an amount of $637,500 and a grant of $1,912,500 (75%) from the Ministry of Highways and Transportation; and that funding for the Mayhew Avenue project will be from the following City Accounts: 2014 Surfaced Streets rollover - $431,000, 2015 Surfaced Streets contracted services - $400,000 and 2015 Surface Streets reserves - $500,000.

City Clerk- Donating Farm Land to the Yorkton Terriers for 2015 [27.10(e)(i)(iii),(f)(v)]

That we accept Recommendation No. C00014-2015 as contained in the Committee of the Whole Council Meeting Minutes of May 11, 2015 that Council approve the donation of a Pt. N.W. 12-26-5-W2 (72 acres), a Portion of Parcel A, Plan AX964 (25 acres), and a Pt. of N.W. 31-25-4-W2 (77 acres) to the Yorkton Terrier Junior Hockey Booster Club Inc. for fundraising purposes for the year 2015, with the condition that the City of Yorkton is acknowledged by way of signage on the lands and in any other pamphlets or advertisement that the club produces regarding fundraising, and a lease agreement be entered into as per the ‘Leasing of City Owned Lands - Policy’.
