Minutes of the Regular Council Meeting held on Monday, January 25, 2016 in City Hall Council Chambers.

Present: Mayor Bob Maloney, Councillors Les Arnelien, Ross Fisher, Randy Goulden, Larry Pearen, James Wilson and Chris Wyatt

Staff Members Present: Lonnie Kaal - City Manager, Kathy Ritchie - Director of Legislation and Procedures (City Clerk), Shannon Bell - Director of Finance, Michael Eger - Director of Planning, Building and Development

A quorum being present Mayor Bob Maloney in the chair called the meeting to order at 5:00 p.m.

HEARING OF PETITIONS, PUBLIC NOTICES AND PRESENTATIONS

Councillor Goulden declared a Conflict of Interest in the next matter on the agenda and vacated the Council Chambers - 5:01 p.m.

Presentation – Yorkton Tourism – 2015 Accomplishments and Successes

A letter and 2015 Report, received January 20, 2016 from Yorkton Tourism regarding their 2015 Accomplishments and Successes was circulated for the consideration of Council. Neil Thom - President, was in attendance to make a presentation.

Jason Popowich - President, and Rick Bilous -Vice President of the Yorkton Sno-Riders Club joined Neil Thom and presented to Mayor Maloney, the 2016 Sno-Riders Sledtown Championship Trophy that their club received from Sno-Riders West Magazine. Jason Popowich made a few comments in regards to the Sledtown Competition, thanking City residents, City Council and City Administration for all of their assistance in achieving this award.

Councillor Goulden was invited back into the Council Chambers as the matter she had declared a Conflict of Interest in had been dealt with - 5:08 p.m.

Presentation – Canadian Junior Girls 2015 Golf Championship held at Deer Park – Picture Slideshow and Financial Summary

An email received January 18, 2016 from the ‘Organizing Committee’ regarding the Canadian Junior Girls 2015 Golf Championship held at the Deer Park Golf Course, was circulated for the consideration of Council. Don Kunkel - Chair, was in attendance to make a presentation. Dick DeRyk and Chuck Orem, Committee Members were also in attendance.

That Council receive and file the presentation from the Canadian Junior Girls 2015 Golf Championship Organizing Committee regarding the 2015 Golf Championship held at Deer Park Golf Course and acknowledge the $10,000.00 donation towards ‘forward tees’ for the golf course.

Bylaw No. 1/2016 -The Procedures Bylaw [2nd & 3rd Reading]

A report dated January 20, 2016 from the Director of Legislation and Procedures (City Clerk) regarding proposed Bylaw No. 1/2016, A Bylaw to Provide for the Governing and Regulation of the Proceedings of City Council and Council’s Committees for the City of Yorkton was circulated for the consideration of Council. Kathy Ritchie - Director of Legislation and Procedures (City Clerk) presented the report.

That Bylaw No. 1/2016 being A Bylaw of the City of Yorkton in the Province of Saskatchewan To Govern and Regulate the Proceedings of City Council and Council’s Committees be amended as follows:
a) Subsection 2.1(1) - the addition of a Definition for “Conflict of Interest”.
b) Subsection 2.1(n) –add to the definition of “Communication” to include a ‘website article’.
c) Subsection 13.2(g) – add to the requirement for a communication to appear as a delegate to ‘include a detailed written brief of the presentation to be made to Council’.
d) Subsections 20.4 – 20.11 - the addition of the detailed process for a member in declaring a conflict of interest.
e) Subsection 33.1(m) – the addition of including in the recording of the Minutes ‘any other items required as set out in this bylaw;
f) Subsection 56.4 - the addition to Membership of a Council Committee:
‘An employee of the City of Yorkton is ineligible for appointment as a member of a Council Committee’.

That Bylaw No. 1/2016 being A Bylaw of the City of Yorkton in the Province of Saskatchewan To Govern and Regulate the Proceedings of City Council and Council’s Committees be read a second time as amended.

ADMINISTRATIVE REPORTS

Director of Finance – City of Yorkton Mobile Home Park Analysis

A report dated January 20, 2016 from the Director of Finance regarding the City of Yorkton Mobile Home Park was circulated for the consideration of Council. Shannon Bell - Director of Finance, presented the report.

That Council rescind the portion of the resolution passed on March 11, 2013 as to the monthly land rental rate increase for the City of Yorkton mobile home park effective January 1, 2016 of $350.00.

That Council set the monthly land rental rate for the City of Yorkton mobile home park as of July 1, 2016 to be $285.00.

That Council retain ownership of the City of Yorkton mobile home park; and further that the monthly land rental of the City of Yorkton mobile home park be set at $295.00 effective July 1, 2017, $305.00 effective July1, 2018, and $315.00 effective July 1, 2019, and further that Administration provide a report to Council in the first quarter of 2019 indicating current market with the objective of setting rates for 2020/2021/2022/2023.

Director of Human Resources – Yorkton Fire Protective Services Review

A report dated January 21, 2016 from the Director of Human Resources regarding the Yorkton Fire Protective Services Review was circulated for the consideration of Council. Chris Wentzell - Director of Human Resources, presented the report.

That we accept Recommendation No. C0008-2016 as contained in the Committee of the Whole Council Meeting Minutes of January 25, 2016 that Council authorize Administration to enter into a four (4) year agreement with ABS Golf Management to provide Director of Golf Services at the Deer Park Golf Course that includes all the terms and conditions of the previous contract plus the addition of an annual cost of living increase, equivalent to the council approved annual cost of living increase provided to out-of-scope staff, applied to the retainer paid to the Director of Golf.

Councillor Fisher opposed.

That we accept Recommendation No. C00010-2016 as contained in the Committee of the Whole Council Meeting Minutes of January 25, 2016 that, due to concerns raised in the December 24, 2015 JC Kenyon Engineering Inc. - Structural Engineering Assessment of the JJ Smith Mill, Council authorizes Administration to take the following actions:
a. The JJ Smith Mill Committee be directed to expedite their report to the April 11, 2016 Council meeting and provide financial statements and fundraising plans to determine their ability to achieve the stabilization of the structure in the method provided in the original JC Kenyon Engineering Inc. Assessment Report dated August of 2012;
b. The building continue to be monitored on a monthly schedule by City Building Officials using more accurate bench marks, watching for the potential collapse which could affect the neighboring properties.

Councillor Wilson opposed.

That we accept Recommendation No. C00011-2016 as contained in the Committee of the Whole Council Meeting Minutes of January 25, 2016 that Council reject the $60,000.00 tender price submitted for Tax Title property (Lot 52, Block 1, Plan 101989255) as the amount is deemed not sufficient to cover all amounts outstanding regarding the property and further that Administration add the property to its listing of properties for sale.

That we accept Recommendation No. C00012-2016 as contained in the Committee of the Whole Council Meeting Minutes of January 25, 2016 that Council include a sixth option for consideration in their decision regarding the level of service to establish for the Yorkton Fire Protective Services Department, that was presented in co-operation between City Administration (Fire Chief and Deputy Fire Chief) and IAFF Local 1527 Yorkton Professional Firefighters.
Carried Unanimously.***
