January 30, 2017

Minutes of the Regular Council Meeting held on Monday, January 30, 2017 in City Hall Council Chambers.

Present: Mayor Bob Maloney, Councillors: Ken Chyz, Randy Goulden, Quinn Haider, Mitch Hippsley, Aaron Kienle, and Darcy Zaharia.

Staff Members Present within the bar: Kathy Ritchie - Director of Legislation and Procedures (City Clerk,) and Michael Eger - Director of Planning, Building & Development.

Regrets: Lonnie Kaal – City Manager, and Shannon Bell – Director of Finance.

Director of Engineering & Asset Management and Bylaw Coordinator - Proposed Bylaw No. 18/2016 – Traffic Bylaw [2nd & 3rd Reading]

A report dated January 23, 2017, from the Director of Engineering and Asset Management and the Bylaw Coordinator, regarding Proposed Bylaw No. 18/2016 – The Traffic Bylaw, was circulated for the consideration of Council. René Richard - Director of Engineering and Asset Management, and Nicole Baptist - Bylaw Coordinator were in attendance to present the report to Council.

That Bylaw No. 18 /2016 being A Bylaw of the City of Yorkton in the Province of Saskatchewan To Regulate Traffic, the Use of Public Streets and to Preserve Order Thereon be read a second time. ***

That Bylaw No. 18 /2016 being A Bylaw of the City of Yorkton in the Province of Saskatchewan To Regulate Traffic, the Use of Public Streets and to Preserve Order Thereon be amended as follows:
a) Section 3 – remove the written form of weight restrictions in “Commercial Vehicle” and “Heavy Vehicle” definitions.
b) Subsection 13(7) – insert the words “Bylaw Enforcement Officer”.
c) Subsection 16(1) – insert this clause reading “No person shall obstruct a street or lane without first obtaining a Street & Lane Use Permit.”
d) Subsection 17(1) – insert this clause reading “No person shall obstruct a sidewalk without first obtaining a Temporary Sidewalk Use Permit.”
e) Subsection 20(1) – insert the words “All sidewalks fronting or abutting any school grounds or properties” and remove the words “All persons owning or occupying property specified”.
f) Subsection 37(1) – remove the word “public” and insert the words “where a sidewalk is available.”
g) Subsection 37(1)(a) – insert the words “Where no sidewalk is available, no person shall engage in a pedestrian-assisted activity more than two abreast on any street or lane and shall proceed in a direction opposite to vehicular traffic.”
h) Subsection 37(3) – remove this subsection.
i) Subsection 49(3)(a) – remove the reference to Schedule “Q”.
j) Subsection 50(1) – remove the reference to Schedule “R” and give City Manager Designate authority to establish 15-Minute Meter parking spaces.
k) Subsection 51(6) – insert the words “A person shall: (a) enter or leave an off-street parking lot in accordance with painted lines or directional signs posted in that area, and; (b) where parking stall boundaries are indicated by painted lines, a meter, pole, sign, or other device, park a vehicle entirely within the boundary of a parking stall.”
l) Subsection 52(1) – remove the reference to Schedule “S”.
m) Subsection 52(3) – insert the words “A person shall: (a) enter or leave an off-street parking lot in accordance with painted lines or directional signs posted in that area, and; (b) where parking stall boundaries are indicated by painted lines, a meter, pole, sign, or other device, park a vehicle entirely within the boundary of a parking stall.”
n) Subsection 53(1)(c) – and remove the words “in accordance with the posted signs” and insert “except: (i) for the purposes of using that facility, or; (ii) if granted permission by the Director of Community Development, Parks and Recreation or his/her designate only for the Gallagher Centre, Yorkton Public Library, Kinsmen Arena, Godfrey Dean Cultural Centre or Gloria Hayden Centre private parking lots”.
o) Subsection 53(2) – remove the word “Disabilities” and insert the word “Abilities”.
p) Subsection 58(2) – remove the word “Disabilities” and insert the word
“Abilities”.
q) Schedule “H” – insert the updated Snow and Litter Removal Map.
r) Schedule “Q” – insert “City Hall Parking Permit” to “Conditions” title. Remove the example City Hall Parking Permit and City Hall Daily Parking Permit.
s) Schedule “R” – remove this schedule and rename all subsequent Schedules accordingly and adjust references of such throughout the Bylaw.
t) Schedule “S” – insert “Parking Permit” to “Conditions” title. Remove the example Parking Lot Permit.
u) Schedule “T” – change “Parkland Library” to “Yorkton Public Library”.
v) Schedule “Y” – change fine for Bylaw offences listed as Section 37(1), 37(2), 41(1), 41(2), 43(1), 43(2), 44(1), 49(3), 50(3), 51(3), 51(6)(a) or (b), 52(1)(c), 52(3)(a) or (b), 53(1), 54, 57, and 60(1) to $45.
w) Schedule “Y” – insert fine for Bylaw Section 19(2) in the amount of $75 for placing an item that causes obstruction.
x) Schedule “Y” – change fine for Bylaw Section 50(3) to $35 for parking at expired meter.
y) Schedule “Y” – insert fine for Bylaw Section 51(6)(a) or (b) in the amount of $50 for Enter, leave or park in an off-street parking lot other than as indicated.
z) Schedule “Y” – insert fine for Bylaw Section 52(3)(a) or (b) in the amount of $50 for Enter, leave or park in an off-street parking lot other than as indicated.
aa) Schedule “Y” – insert fine for Bylaw Section 71(2) in the amount of $50 for Removing or erasing a chalk mark placed on a tire.

Director of Finance – Mobile Home Park Account Write-Off

A report dated January 17, 2017, from the Director of Finance regarding a Mobile Home Park Account Write-Off was circulated for the consideration of Council. In the absence of Shannon Bell - Director of Finance, Amber Matechuk – City Controller was in attendance to present the report to Council.

R.C.M.P. Staff Sergeant - R.C.M.P. Security Clearance Fees

A report dated January 19, 2017, from the Yorkton Municipal Royal Canadian Mounted Police (R.C.M.P.) Staff Sergeant regarding R.C.M.P. Security Clearance Fees was circulated for the consideration of Council. Jeff Simpson – Staff Sergeant was in attendance to present the report to Council.

A report dated January 17, 2017, from the Director of Environmental Services & Capital Projects regarding a Provincial Territorial Infrastructure Component Program and Clean Water and Wastewater Fund Program – North Sewer System Upgrades was circulated for the consideration of Council. Michael Buchholzer - Director of Environmental Services & Capital Projects was in attendance to present the report to Council.

That Council support the application for a Provincial Territorial Infrastructure Component (PTIC) Program Grant and/or Clean Water and Wastewater Fund (CWWF) Grant, through the waste water component, to assist in funding the North Sewer System Upgrades Project that was approved in the 2016 Capital Budget; and further agree to meet legislated standards, to meet the terms and conditions of the relevant PTIC and /or CWWF program, to conduct an open tendering process, to manage the construction of the project, to fund the municipal share of the construction cost, to fund ongoing operation and maintenance costs, and to follow any mitigation measures as required by The Canadian Environmental Assessment Act and The Environmental Assessment Act (Saskatchewan.)”

That Council approve the following amendment to the Saskatchewan Lotteries Community Grant Program Policy: Clause 5(a) current wording is removed in its’ entirety and is replaced with “Application deadlines are at the close of the business day on March 1 and October 1; and if the deadline date falls on a weekend or statutory holiday, applications may be submitted to the SecurTek Information Kiosk at the Gallagher Centre.”
