Home Based Businesses and Home Occupations are required to hold valid business licenses per City of Yorkton Business License Bylaw 8/2006. In addition to the Business License Bylaw, they are also governed by the Zoning Bylaw 14/2003 and the Sign Bylaw 16/2003.
WHAT IS A HOME BASED BUSINESS/HOME OCCUPATION?
The Zoning Bylaw defines a Home Based Business as any occupation, trade, profession or craft conducted for gain from a dwelling unit, which use is incidental and secondary to the residential use of the dwelling and does not change the character thereof.
A Home Occupation means any occupation, trade, profession or craft conducted for gain in a dwelling unit by the resident or residents of the premises, which use is clearly incidental and secondary to the residential use of the dwelling and does not change the character thereof.
WHAT TYPE OF HOME BASED/HOME OCCUPATIONS ARE PROHIBITED?
- auto body repair and paint shops
- automotive maintenance
- auto wrecking/junk yards
- farmers’ markets
- any business using hazardous substances or dangerous goods
- any business using building material products
- retail sales of products not manufactured or having value added processing attributed to the product in the residence
- any business, which in the opinion of the License Inspector, may disrupt the neighbourhood
HOW ARE HOME BASED/HOME OCCUPATIONS AFFECTED BY THE ZONING BYLAW?
The Zoning Bylaw permits Home Based Business and Home Occupations as prescribed by the Business License Bylaw in those residential areas zoned:
- General Residential—R1
- Low Density Residential—R2
- Medium Density Residential—R3
- High Density Residential—R4
- Manufactured Home Residential–R6
Home Occupations are permitted in Mixed Density Residential—R5. Home Based Businesses are a Discretionary Use in Mixed Density Residential—R5 and approved by Council through the detail in the Zoning Bylaw.
Whether a Permitted or Discretionary Use, all Home Based Business and Home Occupations shall conform to the regulations found in Section 7.6 of the Zoning Bylaw.
Every new application is subject to a one time $50.00 administration fee to set up the account. The business license is $50.00 per calendar year for businesses based inside the City of Yorkton’s corporate limits.
Renewal is automatic each January and it is the responsibility of the licensee to advise the City if they are no longer operating a business in the City of Yorkton.
Any form of advertising or promoting of a business activity shall be deemed prima facie proof of the fact that the business or person is carrying on such activity.
The City of Yorkton reserves the right to issue business licenses regardless of application having been made and to take action in the collection of such license fees as is determined necessary.
CAN I ADVERTISE MY HOME BASED BUSINESS/HOME OCCUPATION?
Yes you may, however the address of the business may not be advertised.
