REGULAR COUNCIL MEETING MINUTES
October 17, 2016
Minutes of the Regular Council Meeting held on Monday, October 17, 2016 in City Hall Council Chambers.
Present: Mayor Bob Maloney, Councillors: Les Arnelien, Ross Fisher, Randy Goulden, Larry Pearen, James Wilson, and Chris Wyatt
Staff Members Present within the bar: Lonnie Kaal - City Manager, Kathy Ritchie - Director of Legislation and Procedures (City Clerk,) Shannon Bell – Director of Finance, and Michael Eger – Director of Planning, Building & Development.

CALL TO ORDER
A quorum being present Mayor Bob Maloney called the meeting to order at 5:00 p.m.
APPROVAL OF AGENDA
That the Regular Council Meeting Agenda and Committee of the Whole Council Meeting Agenda be approved as presented.
Councillor Pearen acknowledged three (3) items:
1) He congratulated the Yorkton Business Improvement District (YBID) Downtown, stating that he is proud of the CTV ads that have been airing promoting local businesses and encouraging shopping in Yorkton businesses. It’s a great promotion of the City and YBID is doing a good job!
2) He announced that there is a Fall Concert this Sunday, October 23, 2016 at 2:00 p.m. at St. Andrew’s United Church, with the Community Concert Band, that he directs and a Choir, stating that he hoped to see you there!
3) He also stated that it may be the last Council Meeting, as some of the Councillors may not be returning! Councillor Pearen took the opportunity to thank the staff, those present in Council Chambers, and those who were not. Councillor Pearen thanked everyone for their hard work and all the good things that they do. He then thanked his fellow Councillors for the fellowship of four (4) years together on Council, and that “it’s been great.” Councillor Pearen then specially thanked Mayor Maloney for his leadership, and noted, “we’ve had some good and bad times, and we are doing well.” Some items Councillor Pearen noted that he is especially proud of are:
- 42% Debt reduction in the last four years
- 43% Business License increase
- 10% increase in housing
- 8.2% in population
Councillor Pearen states that he feels the current Council is leaving the next Council in “good standing” whoever it is, and thanked his colleagues for a good four years.
Mayor Maloney passed the Chair to Deputy Mayor Wyatt 5:02 p.m..
Mayor Maloney commented about his wishes to see the citizens vote at the upcoming Municipal Election being held on Wednesday, October 26, 2016. He would like to see a better turnout than the last election which he remarks just under 30% of the electorate voted. He stressed that it’s important that everyone exercise their franchise, encouraged everyone to do their research, pick candidates, and vote on October 26th, 2016.
Mayor Maloney reclaimed the chair from Deputy Mayor Wyatt at 5:03 p.m..

That Council receive and file the Planning and Infrastructure Commission Meeting Minutes of September 14, 2016.
HEARING OF PETITIONS, PUBLIC NOTICES AND PRESENTATIONS
Presentation –The Royal Canadian Legion – General Alexander Ross Branch No. 77 – Proclamation Request - November 5-11, 2016 as “Veteran’s Week” in Yorkton
A letter received October 3, 2016 from Barry Whitehead – President and Poppy Chair of the Royal Canadian Legion General Alexander Ross Branch No. 77, Yorkton, regarding a request for November 5-11, 2016, to be proclaimed as “Veteran’s Week” in Yorkton, was circulated for the consideration of Council. Barry Whitehead, President and Poppy Chair and Kathy Gordon, Past President of the Royal Canadian Legion General Alexander Ross Branch No. 77, Yorkton, were in attendance to make a presentation to Council.
That Council authorize the Mayor to proclaim November 5-11, 2016 as “Veteran’s Week” in the City of Yorkton, and further that the Flag of Remembrance be flown at City Hall during Veteran’s Week.
Presentation – The Yorkton Chamber of Commerce & Yorkton Exhibition Association – Proclamation Request October 31- November 6, 2016 as “Agriculture Week” in Yorkton
A letter received on October 7, 2016, from Juanita Polegi - Executive Director of the Yorkton Chamber of Commerce, and Patty Stewart - Acting Manager of the Yorkton Exhibition Association, raising awareness about the Annual Harvest Showdown from November 2 - 5, 2016, as well as requesting the proclamation of October 31 - November 6, 2016 as “Agriculture Week” in the City of Yorkton was circulated for the consideration of Council. Juanita Polegi - Executive Director of the Yorkton Chamber of Commerce, was in attendance to make a presentation to Council.
That Council authorize the Mayor to proclaim October 31 - November 6, 2016, as “Agriculture Week” in the City of Yorkton.
Public Hearing – Re: Public Notice - Discretionary Use Application 03-2016 – for Family Child Care Home 454 Darlington Street East
There were two (2) written submissions received from the public and no petitioners were present in Council Chambers to speak in regards to Discretionary Use Application 03-2016 – for a Family Child Care Home at 454 Darlington Street East. Written Submissions were received from neighbouring property owners:
a) Mike and Tammy Shannon on October 8, 2016; and
b) Scott Park on October 13, 2016
The City Clerk read aloud, verbatim, the written submissions from Scott Park, and Mike & Tammy Shannon for the record.
That Council receive and file the two written submissions received on October 8, and October 13, 2016, submitted by two (2) neighbouring property owners, one with concerns and one in opposition to the proposed Discretionary Use Application 03-2016 for a Family Child Care home at 454 Darlington Street East.
BUSINESS ARISING OUT OF PETITIONS, PUBLIC NOTICES AND PRESENTATIONS
Planner – Planning, Building & Development - Discretionary Use DU03-2016 Family Child Care Home in R-1 Zone - 454 Darlington St. E.
A report dated October 12, 2016, from the Planner - Planning, Building & Development, regarding the Application for Discretionary Use DU03-2016 for a Family Child Care Home in R-1 Zone – 454 Darlington St. E., was circulated for the consideration of Council. Carleen Koroluk - Planner was in attendance to make a presentation to Council.
That Discretionary Use application DU03-2016, which proposes a Family Child Care Home use at 454 Darlington Street East, legally described as Lot 44, Block 93, Plan 87Y08562, be approved and that the Development Officer be authorized to issue a Development Permit.
That council direct Administration to carry out a comprehensive review on traffic related issues in school zones, parks and child care centres and provide a report to the first Council meeting scheduled for April, 2017 on potential options for managing those; and further that Administration inform the RCMP of the concerns raised regarding 454 Darlington Street East and therefore that they be requested to increase traffic awareness and enforcement at that location.
That Council receive and file the following correspondence:
-Adoption Support Centre of Saskatchewan Inc - Proclamation Request for November 2016 as “Adoption Awareness Month”
Director of Planning, Building and Development - Business Licensing – Out-of-Town Businesses
A report dated October 11, 2016, from the Director of Planning, Building & Development, regarding the Business Licensing – Out-of-Town Businesses, was circulated for the consideration of Council. Michael Eger - Director of Planning, Building &Development presented the report to council.
That Council receive and file the report relating to Business Licensing for Out-of-Town Businesses, as presented.
That Council direct the Gallagher Centre Management Board to carry out a review of the rental rates that they charge for rental of their facilities and lands and provide a report to council at a 2017 council meeting.
Mayor Maloney had passed the Chair to Deputy Mayor Wyatt from 5:47p.m. – 5:48 p.m. prior to the vote on Resolution No. R00314-2016 being taken.
Director of Finance - Tax Enforcement Proceedings List of Land in Arrears
A report dated October 12, 2016, from the Director of Finance regarding the Tax Enforcement Proceedings List of Land in Arrears, was circulated for the consideration of Council. Shannon Bell – Director of Finance presented the report to Council.
That Council authorize the advertisement of the attached List of Lands in Arrears in its entirety as per Section 3 of The Tax Enforcement Act.
City Manager - Public Awareness Report – October 2016
A report dated October 12, 2016, from the City Manager regarding the Public Awareness Report – October 2016, was circulated for the consideration of Council. Lonnie Kaal – City Manager presented the report to Council.
That Council receive and file the Public Awareness Report of October 17th, 2016 as presented by the City Manager.
GIVING NOTICE OF MOTION
COMMITTEE OF THE WHOLE COUNCIL MEETING
That this Regular Council Meeting move into the Committee of the Whole Council Meeting – 6:09 p.m.
That Council rise and report from the Committee of the Whole Council Meeting – 6:23 p.m.
That Council accept Recommendation No. C00058-2016 from the Committee of the Whole Council that authorization be granted under Section 22 of The Tax Enforcement Act to proceed with an application for “Six Month Notice” for title to the properties listed below, but that Administration be authorized not to commence proceedings on any properties where a reasonable effort is being made to pay the tax arrears.
