REGULAR COUNCIL MEETING MINUTES
January 8, 2018

Minutes of the Regular Council Meeting held on Monday, January 8, 2018 in City Hall Council Chambers.

Council Present: Mayor Bob Maloney, Councillors Ken Chyz, Randy Goulden, Quinn Haider, Mitch Hippsley, Aaron Kienle and Darcy Zaharia.

City Administration Present within the bar: Lonnie Kaal – City Manager, Terrence Schneider – Director of Legislation and Procedures (City Clerk), Michael Eger – Director of Planning, Building & Development and Jessica Matsalla – Assistant City Clerk.

A quorum being present Mayor Bob Maloney called the meeting to order at 5:00 p.m.

PUBLIC ACKNOWLEDGEMENTS

Councillor Goulden:
In light of celebrating Ukrainian Christmas and New Year, Councillor Goulden expressed greetings and best wishes in the Ukrainian tongue to honour the heritage of many residents of this community who celebrate these holidays by the Julian calendar.

Councillor Haider:
Thanked the Kinsmen and volunteers who ran “Operation Red Nose” through the Christmas and New Year season to help keep impaired drivers off the road. They contributed to more people getting home safely, and less impaired driving convictions over the holidays.

Councillor Kienle:
Reminded everyone that January was proclaimed “Active Living Month” in Yorkton, and there are many special offers to encourage usage of the activities, facilities, and spaces the city has to get active! Swimming, walking tracks, and the cross-country ski trails to mention a few. Information is available online.

Acknowledged the Public Works Department for working hard always, especially during the recent frigid snap of weather we endured.

Mayor - 2018 Council Committee Appointments
A letter dated January 3, 2018 received from His Worship Bob Maloney regarding the 2018 Council Committee Appointments was circulated for the consideration of Council.

HEARING OF PETITIONS, PUBLIC NOTICES AND PRESENTATIONS

The representatives of the East Central Research Foundation were not present at this point in the meeting. Mayor Bob Maloney continued to the next order of business on the agenda.

Public Notice – Purchase of Four (4) Agricultural Avenue Lots by Habitat for Humanity
The City Clerk advised Council that appropriate public notice was provided in accordance with The Cities Act and the City of Yorkton’s Public Notice Policy.

The Council acknowledges that appropriate Public Notice was provided in regards to the proposed sale of four (4) Agricultural Avenue Lots to Habitat for Humanity below market value and without public offering and that this information be received and filed.

Public Hearing – Proposed Bylaw No. 18/2017 The Property Standards Bylaw [2 Written Public Submissions Received (Deemed Affected]
The City Clerk stated that there were two (2) written submissions that were deemed affected with respect to Proposed Bylaw No. 18/2017 - The Property Standards Bylaw. The City Clerk noted that there were 2 other presenters present in Council Chambers to make presentations to Council regarding the proposed bylaw.

Elaine Smith and Gerry Berezowski, deemed affected spoke 5:07-5:10 p.m.
Larry Wiwarchuk declined the opportunity to speak.

The two written submissions were read aloud verbatim by the City Clerk.

BUSINESS ARISING OUT OF PETITIONS, PUBLIC NOTICES AND PRESENTATIONS

Bylaw Coordinator and Building Official Class III - Property Standards Bylaw No. 18/2017 [2nd and 3rd Readings]
A report dated January 2, 2018 from the Bylaw Coordinator and the Class III Building Official regarding proposed Bylaw No. 18/2017, New Property Standards Bylaw, was circulated for the consideration of Council. Nicole Baptist - Bylaw Coordinator and Jeff Fawcett - Class III Building Inspector, presented the report to Council.

That Bylaw No. 18/2017 being A Bylaw of the City of Yorkton in the Province of Saskatchewan to set and enforce standards to regulate the maintenance of properties and structures within the City of Yorkton and to ensure that all properties are continuously maintained in a reasonably attractive, tidy and safe condition be introduced and read a second time.***

That Bylaw No. 18/2017 being A Bylaw of the City of Yorkton in the Province of Saskatchewan to set and enforce standards to regulate the maintenance of properties and structures within the City of Yorkton and to ensure that all properties are continuously maintained in a reasonably attractive, tidy and safe condition be amended as follows:
a) Section 3 – remove the words “typically”, “eating”, and “living” from the “Dwelling unit” definition.
b) Section 3 – insert the definition “Green space” as “Green space means a municipally owned area of grass, trees, or other vegetation set apart for recreational or aesthetic purposes that is accessible to the public, and includes a park, or City-owned or Province-owned buffer, walkway, or reserve parcel.”
c) Section 3 – remove the words “automobile, tractor, truck,” and “or other vehicle”; and insert the words “vehicle or” and “but shall not include commercial vehicles,” for the “Junked vehicle” definition.
d) Section 3 – insert the words “that isn’t loaded on a trailer” after the word ATV and insert the words “that isn’t loaded on a trailer” after the word snowmobile, in the “Recreational Vehicle” definition.
e) Subsection 16(2) – insert the subsection to state “Where a property abuts a green space, the property owner or occupant of that property shall prevent excessive growth of weeds and grass 0.6 metres beyond the property line that abuts the green space.”

City Manager - Purchase of Four (4) Agricultural Avenue Lots by Habitat for Humanity
A report dated January 3, 2018 from the City Manager regarding the purchase of four (4) Agricultural Avenue Lots by Habitat for Humanity was circulated for the consideration of Council. Lonnie Kaal - City Manager presented the report to Council.

That Administration be directed to enter into an agreement to sell Lots 11,12,13 & 14 Block C, Plan 46116, civically known as 51, 57, 61, & 65 Agricultural Avenue in their current condition to Habitat for Humanity Homes for $60,000 plus GST which shall be paid in four (4) annual instalments of $15,000; the first due upon agreement execution, and the remaining three (3) by December 31, of 2019, 2020, and 2021 plus the cost of water and sewer connections as required with a capped actual cost of $10,000 per connection and furthermore that land title transfers to owners will only be completed upon lot payment to the City of Yorkton.

City Manager - Habitat for Humanity Restore Loan Write-off/ Proposed Bylaw No. 1/2018 Repeal Bylaw (Repeal Bylaw No. 10/2014, Loan Agreement – Habitat for Humanity Restore)
A report dated December 29, 2017 from the City Manager regarding Proposed Bylaw No. 1/2018 Repeal Bylaw to repeal Bylaw No.10/2014, Loan Agreement - Habitat for Humanity was circulated to Council. Lonnie Kaal - City Manager presented the report to Council.

Planner - Discretionary Use 01-2018 – Community Facility in C-4 Neighbourhood Commercial Zone 387-B Parkview Road Council Report #1 – Public Notice Authorization
A report dated January 2, 2018 from the Land Use Planner regarding the proposed discretionary use was circulated for the consideration of Council. Carleen Koroluk - Land Use Planner presented the report to Council.

A report dated January 3, 2018 from the Director of Community Development, Parks & Recreation regarding the appointment of a Pest Control Officer, Weed and Municipal Inspector for 2018 was circulated to Council. Darcy McLeod - Director of Community Development, Parks & Recreation presented the report to Council.

Presentation – East Central Research Foundation - Update on Research Farm Operations

Representatives from the East Central Research Foundation arrived with the intent of presenting their content to Council regarding the Update on Research Farm Operations.

An email received on January 3, 2018 was received from Glenn Blakley of the East Central Research Foundation, asking to provide an update on farm operations and to acknowledge the City’s support for the research work at the farm site. Due to illness, Mr. Blakley was unable to present. In his absence, Ken Walder and Gwen Machnee of Parkland Regional College/East Central Research Foundation presented to Council.

RESOLUTIONS RESULTING FROM IN CAMERA SESSION

That Parkland Regional Library be informed as follows:

i. Up to four (4) Yorkton Public Library board members (one of which will be a Councillor) and alternates will be appointed members to serve as Parkland Regional Library Board members at Annual Meetings and from which two (2) of the four (4) appointees will serve on the Parkland Library Executive Committee;
ii. That 2018 funding requests will be paid at 2017 Levels – Levy of $65,306.35 to Parkland Regional Library.
iii. That the 2018 Special Building fund levy in the amount of $4,902.90, be withheld in favour of arranging for a meeting to discuss facility operation arrangements between the City of Yorkton, YPL and PRL.
